    Trump fights claims he misled attorney as court weighs effort to force testimony

    Former President Trump railed against reports he misled the attorney representing him in the Mar-a-Lago probe as a court set a series of overnight deadlines in a battle to determine whether the attorney must testify in the investigation.

    ABC News reported Tuesday that D.C. District Court Judge Beryl Howell found sufficient evidence that Trump may have intentionally concealed the existence of additional classified records held at his Florida home from his attorney Evan Corcoran.

    My understanding is Corcoran claims he was misled by Trump with respect to Don's continued possession of classified docs. It's why Corcoran drafted a letter to the DoJ stating Trump did not possess any. If this is so, as Judge Howell says it is based on the evidence, then according to Andrew Weissmann it would mean Individual 1 has legal exposure to a charge of obstruction of justice in Jack Smith's investigation. Because knowingly misleading your attorney who then passes false info on to federal authorities equates to obstruction. According to Weissmann this is exactly what happened to Paul Manafort and why he was convicted, among other things, of obstruction.

    Little words with great importance. It's being appealed, which everyone should want. The lawyer/client privilege principle should be abandoned only in extreme cases. I don't think this is one. (Yea, I know; the never Trump Judge disagrees).

    She's in on the fix. She has been from the start. She retired when she did so she could hopefully avoid the fallout when this goes sideways.

    But, Biden is going to get a free pass. They can't let Biden off Scot free and prosecute Trump. That would be too obvious.

    DC Circuit Issues Lightning-Fast Order Requiring Trump Lawyer To Turn Over Docs To Special Counsel

    A federal appeals court took less than a day to bat away an attempt from President Trump to block an attorney of his from participating in Jack Smith’s investigation. A three-judge panel on the D.C. Circuit Court of Appeals upheld a lower court ruling on Wednesday and ordered Trump attorney Evan Corcoran to hand over records to Smith’s investigation, per a docket entry. The order itself is sealed, as were the lower court’s rulings.

    CNN reported that, per the ruling, Corcoran would also be required to testify before the grand jury. That is likely to take place on Friday. Corcoran came into Smith’s sights for his involvement in the Mar-a-Lago records investigation, in which Trump is suspected of illegally retaining classified government records after leaving office.

    I suppose this goes one of two ways. Corcoran reiterates that Trump misled him about Don's possession of classified docs, the assurance leading Corcoran to draft the letter informing the DoJ of such. Testimony that most definitely would be very bad for Individual 1. Or, Corcoran pleads the 5th because he conspired with Trump to illegally obstruct the DoJ's investigation.

    In particular, prosecutors have been focused on a document that Mr. Corcoran drafted last spring stating that a “diligent search” had been conducted at Mar-a-Lago and that no further classified material remained there — an assertion that would be proved false. Prosecutors have been seeking to learn what Mr. Trump knew about that statement, according to people briefed on the matter.

    The case involves a balancing act between attorney-client privilege, which generally protects lawyers from divulging private communications with their clients to the government, and a special provision of the law known as the crime-fraud exception. That exception allows prosecutors to break through attorney-client privilege when they have reason to believe that legal advice or legal services have been used in furthering a crime, typically by the client.

    @Lee Atwater i have lost all patience with this lame excuse for a "justice system. " 1 trial, maybe a day, with as many defendants as will fit in a courtroom but including every congresscritter who was involved. the charge is RICO, and they all get the maximum sentence.

    the "trump organization" has already been convicted. trump weaseling out of a conviction on that one is a quirk of corporate law.

    I share your frustration, as I'm sure many do. Not just with the incredibly slow pace at which the justice system works, but with Trump's innate ability......thus far.......to break the law without being held accountable. I think his luck is about to run out.
