https://www.politico.com/news/2023/06/01/hunter-biden-supreme-court-second-amendment-00099544 Hunter Biden's lawyers are going to invoke the 2nd amendment if he's charged on the whole being a crackhead and lying on the 4473 thing. Its so strange a series of events, in this topsy turvy, seemingly whimsical timeline, I think it might actually happen. Think about it: Biden doesn't want his child going to prison. He could get an appeal fast tracked if anyone could. Bruen says what it says, so you can totally be a crackhead lying on a 4473 if you can just get your case to scotus. He's got the money for it, the clout, its a legitimate case that can't be dealt with otherwise since Hunter admits to being a crackhead addict during the period he knowingly and intentionally lied on the 4473 by checking the box that says he was not a user of or addicted to any illegal substance. Real case and controversy exists, it starts at the fed level. Buckle up folks, ****'s about to get weird.
have to side with dildo boy Hunter on this one-I don't believe the commerce clause properly supports the Gun Control Act of 1968. However, I believe a state could penalize crack head hunter . So the violation at a federal level should go the way of the Dodo bird
On the other hand, the tired line is we don't enforce the laws we do have. So, in the interest of consistency he should be penalized for perjuring himself on a federal form. Pretty sure that in the federal statutes.
The incident (gun tossed in dumpster) happened in Delaware. I think it is likely the prosecutor's office in the state might decide not to prosecute. Delaware is not considered an especially corrupt state, but 58.74% of the state voters did vote for Joe Biden (versus 39.77% for Trump) in the presidential election, and Delaware is Biden's "home state", with Biden having served as a senior long-time senator representing the state in the U.S. Senate.
To be fair, it might be a higher legal burden to try to be able to prove that he was a crackhead at the time when he purchased the gun. The charge of "drug user in possession" would be legally more straightforward. There's another thread involving this subject here: Mother charged with federal gun crime for marijuana I think most people in that situation would just end up pressured to take a plea bargain and plead guilty, but Hunter Biden has enough money and legal resources from his father to be able to make an attempt to fight this.
