    What part of that is what the court ruled do you not understand? The court literally ruled Congress cannot require any of that on the president and he has an absolute right to follow or not follow it if he pleases. Period. End of discussion.

    It is like these people can't read because they keep saying the same debunked garbage over and over as if it hadn't already been debunked numerous times before with citations.

    Bradley Moss, a Washington-based lawyer who works on national security cases, said Trump’s allies have misconstrued the Clinton socks case.

    The socks ruling addressed whether a private party — Judicial Watch — could get a court to order the archivist to determine whether Clinton had improperly designated the audiotapes recorded during his presidency as personal.

    "The court concluded that the Presidential Records Act did not give the judiciary that authority to require that of the Archivist," Moss said in an email to PolitiFact. "This alternate dimension Mr. Trump thinks exists because of the case in which he can do whatever he wants with records from his presidency insulated from other statutory provisions like the Espionage Act is the stuff of lunacy."

    Trump was indicted under a provision of the Espionage Act that prohibits unauthorized possession of information related to national defense that could be used to injure the U.S.

    Jason R. Baron, former litigation director at the National Archives and Records Administration, also told PolitiFact that the Clinton recordings fit the definition of a "personal record."

    "In contrast, the boxes of records taken to Mar-a-Lago appear to overwhelmingly contain records pertaining to the official business of the White House, and therefore should have been transferred immediately into the legal custody of NARA as presidential records," Baron said.'

    There are, however, penalties under different statutes for destroying White House records. Under the first law, anyone found to have "willfully and unlawfully" concealed, removed, mutilated, obliterated or destroyed any record faces a fine and imprisonment for up to three years.

    A person convicted of this offense can be disqualified from holding future federal office. But in 2015, as Hillary Clinton came under criticism for using a private email server while serving as secretary of state, legal scholars argued the Constitution lays out eligibility criteria for serving as president. Clinton, who was the 2016 Democratic presidential nominee and ran against Trump, was not charged with any crimes related to her handling of federal records.


    A second law states anyone who "willfully injures or commits any depredation against any property" of the U.S. faces a fine or up to one year in prison if convicted.

    Former President Donald Trump slammed Special Counsel Jack Smith Tuesday, calling him a "Thug" and accusing him of planting evidence in the boxes of classified documents that the FBI claims to have found in Trump's Mar-a-Lago home.

    Trump was responding to an article that made unverified claims about Smith being linked to Hillary Clinton and George Soros. He made his comments on his Truth Social, just hours before he was scheduled to attend an arraignment hearing in Miami on 37 federal indictment counts.

    With the exception of the Trump party line -- weaponization of the DOJ -- the silence from Trump Republicans is palpable. They dare not mention the topic of this thread -- the criminal indictment of Donald Trump.

    The former Republican President was arrested today. Deputy marshals booked the former President, and he was fingerprinted. The booking process took about 10 minutes.

    Trump was not handcuffed and his mugshot was not taken, which raises a question. Considering the many lies Trump is spreading about the DOJ and our President, why is it the feds are giving Trump all this consideration?

    When is this man going to get the treatment he deserves?

    How bad is it for Trump? This bad.

    The Guardian reports, "Trump and his legal team spent the afternoon before his arraignment interviewing potential lawyers but the interviews did not result in any joining the team in time for Trump’s initial court appearance scheduled for 3pm ET on Tuesday after several attorneys declined to take him as a client.

    "Trump has also seemingly been unable to find a specialist national security lawyer, eligible to possess a security clearance, to help him navigate the Espionage Act charges.

    "The last-minute scramble to find a veteran trial lawyer was a familiar process for Trump, who has had difficulty hiring and keeping lawyers to defend him in the numerous federal and state criminal cases involving him.

    Through it all, Trump's loyal, silent followers will stay with him. They don't know why, but they will.

    Also, they will not read this report. They avoid learning reality.

    CBS reports, "Former President Donald Trump pleaded not guilty Tuesday to 37 felony counts related to his alleged mishandling of classified documents. This is the first time the Department of Justice has ever charged a former president with a crime.

    "Trump was released on his own recognizance after the 45-minute proceeding. As a condition of his release, he is barred from talking to his aide Walt Nauta, who was charged on six counts in the 44-page indictment, about the case.

    "Trump will not be required to relinquish his passport and there will be no limit on his domestic or international travel. He departed the courthouse just before 4 p.m. ET."

    And now the poor suckers, otherwise known as Trump's followers, are going to pay for his defense.

    The Hill reports, "Former President Trump continued to fundraise off his second indictment by vowing to “never drop out” of the 2024 presidential race.

    “They can indict me, they can arrest me, but I know – and the American people know – that I am an innocent man,” Trump wrote in a fundraising email. “My only offense is challenging the corrupt ruling class and fighting for the forgotten men and women of our country.”

    Many sincerely hope that is true. If Trump is the Republican candidate for President in 2024, the Republican Party won't see the inside of the White House for a few decades.

    In the event of potentially unlawful removal or destruction of government records, Title 44, Section 3106, of the U.S. Code requires the head of a federal agency to notify the Archivist, who initiates action with the Attorney General for the possible recovery of such records.22 The Archivist is not authorized to independently investigate removal or recover records.23



    22 - Under Title 18, Section 2071, of the U.S. Code, anyone found guilty of "willfully and unlawfully" concealing, removing, mutilating, obliterating, destroying, or attempting to do any such action against a record can be fined and imprisoned for up to three years. In addition to fines and possible imprisonment, anyone holding federal office who is convicted of this crime can lose his or her position and be disqualified from holding federal office in the future
