Point to the words in the constitution that supply any other method for removing a sitting president.

Who ordered him to return what? Over the last few months, all of the analysis points to the fact that the FBI and corporate media feel Trump should not have any documents that are marked classified. They are fundamentally wrong.

Under my interpretation of classified documents law, there is a risk of a former POTUS turning on the US as a spy.

Under the corporate media's interpretation over the last few months, not only is there a separation of powers problem, it creates a situation in which unelected bureaucrats can deny the public a presidential candidate based on secret evidence that the public can never see.

Which is a more dangerous interpretation to our "democracy"?

Fascists prosecute on deceit and emotion, not the law.

So under your interpretation, it would behoove the incoming POTUS to stop the outgoing POTUS before he leaves the WH lawn, and rummage through all of his documents in hopes of a gotchya?

Yeah, that was uttered on Capitol Hill in the People's House, and as such, the entire transcripts exists, and is available for all people.

The PRA offers no check on his discretion. It says what he should do, but it doesn't authorize Congress, or the law, any course of action if he doesn't, and offers no penalties if he doesn't. That's why they have to debase our entire legal system by ludicrously alleging that Trump is a foreign spy (almost as ludicrous as alleging he is colluding with Putin for years before finally just giving up).

The case should be dismissed immediately on separation of powers alone. But it should also be dismissed for prosecutorial misconduct and 4th A violations.

There is no separation of powers excuse here. And there is no evidence of prosecutorial misconduct. And there is no evidence of 4th amendment violations.

Nobody supports this except for the OMB Croud and crooked republicans that don't want populism wiping the dust of their ancient party away. Everybody knows this is just corrupt elites clutching onto their power outside of the terminal OMB types. so if the corrupt elites convict trump can run on fighting this corruption.

These aristocrats have created their own worst enemy. Moving ahead with this sham is the best thing for trump. his numbers just keep going up and up.

I see you ignored 2 of my 3 basic questions and dodged on the third.

Let’s try again: a grand jury issued a subpoena in March of 2022 ordering Trump to return all classified documents in his possession. He didn’t and is now facing 37 felony counts, in part because he didn’t.

    What is his defense ?

What analysis? You mean your subjective interpretation. This has nothing to do with the feelings of the FBI or Media, it has to do with you projecting your feelings on the FBI and Media and calling your feelings their feelings. The media states views and opinions based on numerous people's interpretation of relevant applicable laws. You choose to call media views feelings.

Next the FBI does not make its decisions based on feelings. The fact you feel they do does not mean they make their decisions based on "feelings".

Your feelings are immaterial. The law not feelings is very specific on why when a President leaves office the documents Trump took were no longer his. The fact you feel this law does not exist is irrational.

Trump has admitted many times to the public he took classified documents he knew he should not have because he "feels" he can no matter what the law actually says. Its not how the law works. Your feelings parroting Trump's feelings in the long run are inconsequential to the rule of law and the appropriate legal procedures for file management of files when a President leaves office.

Why do you invent things? There is no legal issue that turns documents the personal property of Trump when he leaves office. Once he leaves those documents revert back to public archives where they are kept in trust for all the people of the United States not just you, Donald and his disciples.

There has been no prosecutorial misconduct. The fact you do not want Trump to be charged for any crime does not make charging him misconduct. What are 4th A violations? At this point you try pass of partisan pro Trump parrot denials of what Trump does as legal opinions. They are not based on any law which is why you can not quote any law and apply it to your subjective partisan remarks.

Trump rejected lawyers’ efforts to avoid classified documents indictment
The former president was not interested in attempting to negotiate a settlement in the classified documents investigation, three people briefed on the matter said.

All that has happened is ON Trump and Trump alone. He had many "off ramps". but refused to do what would be the responsible thing.
His judgement is impaired and colored by his raw rage and quest for revenge

He is already planning to tear apart the system that "did this to him" When will folks REALIZE this man in mentally/ psychologically disturbed.
He is paranoid. Everyone can see that He carries a degree of rage that makes him over reactive .
Everything is about him. The degree of narcissism is astoundingly obvious.
He cannot be objective or fair.......as we have al seen from his previous stint at the job of POTUS.

It does not matter that Trump remains popular within the Republican Party, and that fans are paying for his defense fund. It doesn't matter that he remains the self-serving, narcissistic leader of the Republican Party, and the leading Republican candidate for the Presidency.

What matters is, can Trump win an election?

    He hasn't yet.

Note: Trump lost the popular vote in 2016 to the very worst candidate the Democrats could have picked.

Want proof? The forum's Republicans are in hiding.

I explained how it is a separation of powers issue. Congress cannot pass a law that constrains the Chief Executive in how he handles documents, which were created for the sole purpose of performing his executive duty.

And the prosecutorial misconduct is on full display by the fact that CNN, MSNBC, etc., know what's in the documents. Nuclear secrets. Attack plans on Iran. Which FBI agent or DoJ official leaked that stuff?

If they are for his executive duty then they aren't personal documents . . . they are official documents . . . which are covered by NARA.

And the excerpt linked earlier says that NARA cannot veto his decision. I haven't read the entire PRA. But my legal instinct says that that law never lists a person who can override the President's discretion, and that it doesn't list a course of action to challenge that discretion, or any legal penalties associated with the President's noncompliance with an official who challenges that discretion.

And there is no law that turns the documents into a crime as soon as he walks out of the office.

Yesterday, Attorney General Merrick Garland spoke to a television audience concerning the former Republican President's federal indictment. He was introduced by several news correspondents who said that he was defending his special counsel.

Special Counsel Jack Smith does not need defending!

Garland did not defend him. He praised him and explained the DOJ's role in the indictment.

Some news correspondents need to go back to correspondence school for retraining.

I've been watching the media clips from 2021 regarding informing the public on the Covid vaccine. Like the one in which Don Lemon used NOTHING BUT FEELINGS to convince my fellow Americans to not allow me to get food at the supermarket. There are plenty of videos of the media, again obviously operating on pure emotion, revealing their true fascist hearts regarding the vaccine and masks.

Don't lecture me about how the corporate media operates. I'm unvaccinated; I FELT their use of emotion on my fellow citizens.

Members within the FBI are using their positions within our government to effect their political aspirations. There was no accountability for illegally spying on Trump once already. Just like they illegally leaked whatever they felt could be damning to Trump during both impeachments, they are at it again at the outset of this trial, as evidenced by all of the media talking heads' awareness of what these classified documents were.

That is true, but an opinion becomes a fact when there is evidence to prove it. There have been no indictments of Hillary.

Without false premises, distortions and lies, what would the right EVER have?

Hint he's not charged with violating the PRA BTW

"willful retention of national defense secrets in violation of the Espionage Act, conspiracy to obstruct justice, corruptly concealing documents, concealing documents in a federal investigation, scheme to conceal, and making false statements."
