AG Paxton does not have the authority to do so under Texas State law or the US Constitution. Again, it was hyped and as I said, it will not happen. I was, however, somewhat surprised with the Colorado ruling even though Trump has faced similar lawsuits in several other states from Georgia to Arizona to a couple of others.

 

I am not saying it is horrible, nor anything else. Suprised is the more correct term. However, it was not Democrats who brought this up. the arguments under the opinion, IMO, are legally fascinating. SCOTUS could interpret this Section 3 as literally someone being charged under insurrection under 18 USC 2383 as a way out. But the ironic thing is that this helps Republicans more than Democrats. In a worse case scenario for Trump supporters like you, if this was applied nationally, then Nikki Haley would in all likelihood become the GOP nominee. And she has a much better chance at beating Joe Biden in a general election come November than DJT could with all of his inflammatory rhetoric, among other things.

 

It is not the question of the Supreme Court judges, it was the question of who brought up the lawsuit.
