    Okay here is the obvious question even though it's kind of obvious this bill is extremely stupid; is it even constitutional?

    WASHINGTON — The Supreme Court on Thursday upheld President Obama’s health care overhaul law, saying its requirement that most Americans obtain insurance or pay a penalty was authorized by Congress’s power to levy taxes. The vote was 5 to 4, with Chief Justice John G. Roberts Jr. joining the court’s four more liberal members.

    States aren't required to set up the exchanges and roughly half the states have opted out of setting them up. You still have to pay the fine..........I mean "tax" though if you don't get coverage through the federal exchange.

    I forgot exactly what it was about but Oklahoma has a case that supposedly is going to the SCOTUS I think about penalties or something. I will have to look that up later.

    Edit: It has to do with susidies in the 34 states that opted out of state exchanges. http://www.dailyfinance.com/2013/08/21/the-biggest-obamacare-news-getting-little-attentio/

    Let's solve this problem once and for all. Let's kick those idiots out of the country and they can revert to swamp dwellers. They can't cope living in modern America so let's kick them out.

    I don't think our Founding Fathers intended the SCOTUS to be advisory. If they had, they wouldn't have given SCOTUS a third of the power. Jefferson spoke mostly about his view that appointing justices for life was a mistake because that would give SCOTUS an opportunity to gain more power over the other two branches. I've never read anything from Jefferson that stated he thought SCOTUS should be a mere advisory role in government. If you know of any document Jefferson wrote stating SCOTUS should be an advisory role, I would sure love to see it.

    I like this bill on two different levels, viz.:

    (1) I consider ObamaCare an abomination (or, as some have put it, an Obamanation).

    (2) I stand foursquare in favor of states' rights, and the attendant doctrine of nullification.

    As for the question of whether this is constitutional, this is a tacit reference (presumably) to the so-called "Supremacy Clause" of the US Constitution (Article VI, Clause 2).

    But since the left does not seem to revere the Tenth Amendment (which greatly limits the powers of the federal government), I see no reason to fetishize the Supremacy Clause...

    What a shame.. SC has one of the highest rates for blindness and amputations from diabetes in the nation.

    The short answer is no. But like states who are either not enforcing federal anti marijuana laws, or recognizing federal pro gay marriage laws, it comes down to if the DOJ will enforce the law through federal court. In this case I would have to say they will.

    The above observation strikes me as downright bizarre.

    One might (theoretically) argue in favor of the federalist ideal, and against the doctrine of nullification; but to assert that there is simply "no such thing" as nullification is...well, really strange.

    Oh, and as for the Wikipedia reference to an 1809 situation, I have long advocated that the several states should totally ignore all pontifications from the federal courts; and that each state should view its own state supreme court as the highest authority in the land for its own state, and then act accordingly, regardless of the potential upshot...
