    We know he committed a strong arm robbery, we don't know that he assaulted Officer Wilson.

    Aagin we do not know if he assaulted the police officer please post proof of that other than hear say.

    We certainly don't know if he assaulted the officer. I think we can all agree that there is some threshold at which the officer would be and would not be justified in the decision the officer made. What bothers me about this case is the mobs in the streets claiming that Michael Brown is their case in point of police brutality. We don't even have the facts. Rodney King is evidence of police overstepping their bounds, but we don't even know for sure what happened in this case, and Obama and many people in the town of Ferguson jump on the bandwagon of police brutality when the facts are still being sorted out.

    I agree with what you are saying, but its kind of like in the 50s and 60s when folks go tired of seeing their loved ones being lynched, terrorized and beaten and the folks responsible never being brought to the Bar of Justice for it.

    At this point we don't know what happened and I wish folks could wait and let the investigation take its course, but unfortunately when people are in pain they want Justice.

    Since I last posted on this thead, at least two conservatives have made blanket assertions regarding the events of the shooting for which there is nothing more than heresy evidence. Yet they make these claims with absolute certainty, based on no hard evidence whatsoever.

    It is worthwhile looking back over what CNN actually has been reporting.

    As of five days ago, they still had not disavowed the anonymous Josie call, Rather, they compared it's content to the public statements of Dorian Johnson, who was actually there.

    Here is the account of the anonymous caller based on what she read on Facebook, and which has been bandied about here as absolute fact:

    Dorian Johnson tells essentially the same story, but with more detail:

    Alas, because this account does not portray the police in a particularly favorable light, the noise machine felt the need to smear Johnson.

    But other reports, as quoted by CNN appear to reinforce his narrative.

    I dont need to back up anything i am going by the CNN report. I am sure we will find out more after the grand jury is over. You made some grand claim. You falsely tried to back it up with links that did no such thing and now you are desperate and want me to do your work for you? Sorry not how debates work.

    A witness said he saw Brown punching into the Officers vehicle at the Officer. The Chief said the officers face was swollen, so he took him to the Hospital. And it was leaked that he had a fractured eye socket. So it's probably true that Brown assaulted the Officer. I mean, it's not like Cops drive around with swollen faces and fractured eye sockets. Donuts and coffee on their laps maybe. But not fractured eye bones and swollen faces.

    Sorry, I don't buy the ricocheting door scenario. There is NO WAY a car door is going to 'ricochet' with enough inertia to close back on the cop when the car is so close it almost hit the two. "We were so close, almost inches away, The only way is if the two perps shoved it back on the officer slamming him back in the car which is the more likely scenario. Also, the cop (being shoved back in his car) would not have the time to instantly draw his gun and shoot. It's more likely that the 'gentle giant' was on top of the officer grappling for his gun which subsequently went off in the struggle.

    Police reports are used everyday in courts of law, they themselves cannot be introduced as evidence but are regularly used in court cases to refresh the recollection of police officers testimony for sake of accuracy. For instance

    Prosecutor: And at what time did you turn down Maple St. that night.
    Officer: Can I refer to my notes of that night?
    Defense Attorney: Objection
    Judge: Overruled you may refer to your report of that night.....

    Or

    Prosecuter: And which way was the candle stick pointing that night at Major Marple's
    Officer: I can't remember exactly may I refer to my notes.
    Defense attorney sits quietly.

    Dorian Johnson has no credibility as far as statements he gives and the ONLY one that would matter would be his sworn statement to officer immediately after the incident not days later when the public narrative had been created.
    What is key to the Josie statement is that it corroborates the contemporaneous witness statement both of which were given without knowledge of the other and the later before the public narrative had been created. He was just telling a friend exactly what had happened without concern for public opinion and without the influence of protest and Al Sharptons declaring Wilson guilty.

    beat by the cops is so funny? Because it's true.

    And we all know it, but some just won't admit because it

    doesn't fit their agenda.

    This rule also applies to whites believe it or not.

    The cops have an extremely difficult job, they are

    damned if they do and damned if they don't.

    The Democrats have revived the Woodrow Wilson/Jimmy Carter days. Knowing this, and knowing that their political party is solely responsible for it, the TP is a boogeyman meant to distract you from Democratic subversion and outright acts of treason against Americans.

    I did speak too I broadly, my point was a jury would never see them. Yes the arresting officer could give testimony (if it's found to be relevant) and use his notes to refresh his memory.

    But the officer can't sit there and just read them to the jury, that violates best evidence.

    It is, "please read this report to yourself", "do you remember better since reading it?", *takes report away*. Then if opposing counsel wishes they may admit into evidence any document used to refresh memory. But unless that happens the jury won't see it.

    My ultimate point being why publish them to the public is there is a trial to taint the jury? They won't be able to see them.

    I believe that it was Dorian that said Brown was shot in the back. He must be a credible witness.

    Yep, and especially so for a co-suspect in a robbery and co-perpetrator regarding an assault on a police officer who is infamous for lying on sworn testimony documents. The White cops hating Left REALLY outdid themselves this time when it comes to finding . . . a credible witness. I'll bet they are proud of themselves . . . :cool:

    Maybe they shouldn't commit an exponential amount of violent crimes on each other and this wouldn't happen.

    The Michael Donald murder in 1981 is considered the last "lynching" although he wasn't lynched. He was murdered by having his throat slit and then his body was hung across the street from his house. My brother lived two houses down. It was a retaliation by a couple of the few KKKers left for the acquittal of a black man in the killing of a white police officer. The jury was mixed and the african americans on the jury voted to acquit. The man was subsequently retried and convicted. The KKKers were convicted and one executed for it. It is the case that gave the SPLC it's big push into the public limelight and they subsequently sued the KKK out of existence.
