University of Oklahoma expulsions may be speech infringement, experts say

    "NORMAN, Okla.—The University of Oklahoma, which expelled two Sigma Alpha Epsilon members Tuesday for leading a racist chant, may have infringed on the students' right to free speech, some legal experts said......"The irony here is that (Boren is) arguing he's protecting the rights of some students while infringing on the First Amendment rights of other students," said Joey Senat, an associate professor who teaches media law at Oklahoma State University in Stillwater. "The speech is offensive, the speech is abhorrent, but the First Amendment protects unpopular speech."

    I do have to agree with Mr. Senat, offensive YES, abhorrent YES, protected by the First Amendment YES. Will a court rule this way probably NOT.

    Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

    Let me know when they put them in jail. Joey Senat isn't exactly a first amendment scholar. He teaches media law.

    When are we going to quit letting the PC crowd dictate what a person can say? What happened to free speech?

    It's not about laws. It's about university regulations. Violate those and you can't attend anymore. They can shout about how they don't like (*)(*)(*)(*)(*)(*)s all they want, just not on campus.

    University regulations must comply with the first amendment as long as the university is public or recieves public money. Whether that was the case here is debatable, but it could be argued that it was not legal.

    First amendment is about more than just not putting people to prison for speech.

    Free speech does not grant protections from consequences resulting from its exercise.

    So saying (*)(*)(*)(*)(*)(*)s can hang from a tree, but they can't sign with a fraternity is now protected? Sorry, they took it too far. If they just used the term (*)(*)(*)(*)(*)(*), they wouldn't have been expelled.

    I remember PC and multiculturalism being a big thing on my university's campus back in the early 90s (one of the reasons why I'll never identify as a liberal).

    Why should the Military be able to have regulations on it's member's speech but not universities?

    Attending either is entirely voluntary.

    It does from the government.

    But the point is that these students violated the school's Code of Conduct, which they already volunteered to uphold.

    Perhaps they shouldn't have agreed to the school's Code of Conduct and instead gone to another institution that would not have regulations against such speech.

    You dont have rights when they offend minorities (until white people become the minority in the near future). That is how illegal became undocumented and how undocumented will become something else in the future.

    There is no black and white to speech and there may be a clearer case that the court does not involve it self matter sof private institutions...there is also no clear cut rule on speech on campus. The court in rulings has tended to give greater allowance to speech in the academic setting...they do make a distinction between academic free speech and hate speech. Hate speech is not protected speech on campus. The students are an extension of the university.

    They volunteered to follow it and now they want to back out of their end of the bargain. I thought the Rght believed in personal responsibility.

    Laughable! A code of conduct at a university? In the coming days, mark my words, the reverse racism will come out, if it hasn't already; and there will be no mention of any code of conduct. The Christophobes, whitey-haters, left loonies will show their azzes. And there will be silence, crickets, because for some crazy reason it's just ok to be a Christophobe and a whitey-hater and an anti-Semite, but not ok to use the 'N' word in a drunken stupor. This will be fun to watch.

    You say something racist and politically incorrect they throw you out of school and shame you in media.
