http://www.foxnews.com/us/2017/07/0...ound-law-ruled-unconstitutional-by-judge.html Does anyone else see the lunacy here? If you don't see the lunacyPlease describe the difference between standing your ground and proving you were under imminent threat of death or great bodily harm.
Prosecutors complained because they don't want people to "shoot first" if they feel their lives are in danger..... If your life is in danger, why the **** wouldn't you shoot?
Better is a well defined penal code that explains specific cases when lethal force can be used. In NYS lethal force can be used to prevent rape, arson, murder etc. Duty to retreat is not mentioned.
Then perhaps they should stop bringing charges against individuals, unless they believe overwhelmingly that it was indeed murder.
Absofreakinglutely, why would any sane person wait until they were stabbed, shot, or beaten before they use self defense. You can't make this stuff up can you.
Most likely because some people would use bogus excuses such as "he looked at me in a threatening manner and I felt my life was in extreme danger". Just makes unjustified murder acceptable in Florida. Typical.
Ultimately, this ruling means, at least to me that criminals can attempt a criminal act and you have to run away. You know how stupid that is? They act like you are always alone and healthy enough to get away, different circumstances never come to their mind. What one of those prosecutors needs to see is a criminal shooting first and injuring or killing a family member before he or she is allowed to shoot back.
You do know that "he looked at me in a threatening manner and I felt my life was in extreme danger" does not fit Florida's definition of being in imminent threat or great bodily harm, yes? It's not been an issue any where stand your ground is a law BTW
Typical bogus statement in your case. The charge for shooting someone for looking at you crooked would be Murder.
It wouldn't surprise me if they found a way to twist it to fit their definition so it would fit the definition.
Hasn't been an issue except in the mind of those anti gun folks that use whatever is available to punish law abiding citizens.
And yet the "rivers of blood" and "public shootouts" have never happened in Florida, or anywhere else there are CCWs.
Statistics show that is not true. Most people charged with Murder have long criminal histories of juvenile / petty offences. A very tiny percentage of Law Abiding people in the U.S. suddenly commit Murder. Statistics show People with concealed carry commit less Crime than the Police and other law enforcement officers / agents.
If someone breaks into my home, getting past 2 large breed protective dogs, I'm assuming they are intent on criminal activity. So yes I will shoot first and they will not be able to be asked questions...
I hope the Dogs will make such a row that you will know before they break in. Set up sensors (photo electric) cameras, to record and detect / see intruders climbing over fences, walls, opening gates, entering your property, so you know they are approaching your home, before they have a chance to break in.
Dylann Roof comes to mind as does Adam Lanza and James Holmes as well; all apparently law abiding citizens who became non-law abiding citizens once they committed mass shootings.
Lanza was not in legal possession of the firearms he used to commit mass murder. wanna tell us what gun control law would have stopped Lanza. Oh I know, the law that made the school of gun free zone=if that law hadn't have been passed, maybe the teachers would have had a fighting chance
