This is is a plea to his >100 I.Q. point base who he has convinced that the reason their lives suck so much is because babies born on American soil are Americans by birth if they were born to immigrant parents, instead of them realizing that the tax cuts he pushed through for the ultra wealthy are the real cause of their suffering.

I think it will backfire in so much as those on the left will be even more motivated this mid-term election to counter such ignorant rhetoric.

No, I think "subject to the jurisdiction" as applied to the right of citizenship upon birth, in an 1868 context, is a genuinely debatable question. I know of the custom and historical practice, I've read the Amendment and reviewed its application, this isn't a clear matter, there are cases on either side, the specific question of "anchor babies" has not been addressed. This is a question the Supreme Court could sensibly decide. I don't know how they'd decide. I've still to review at least Wong and Elk, but I don't see this as some fatuous argument and it does seem a transcendental issue.

Why would we reunite the family? Theyve been deported were not letting them back in. If they want to take the child fine, the child can eventually come back as an adult. If not they can surrender the kid and the kid can be a ward of the state until adopted.

They are armed and they are an invasion force funded by foreign governments. We have the right and obligation to defend our nation against all foreign enemies. Give them a plain warning and if they continue their invasion terminate them on the border.

What does the Constitution's 14th Amendment say about birthright citizenship for the children of foreign diplomats? If they are not "subject to the jurisdiction" of the United States, what specifically makes children born to illegals subject to the jurisdiction of the United States?

 

If you commit a crime in Mexico and if they bust you for it you are subject to the jurisdiction on the United States of Mexico but you are not a Mexican citizen.
