So if the woman had gone to a port of entry to claim asylum and her daughter had then died in US custody, you'd be OK with the $60 million claim?

So this is a red herring of a case. The issue in that case was that McDonalds heated it so hot that she got 3rd degree burns. You don't get 3rd degree burns from hot coffee. The whole she should have known it was hot was from McDonalds' lawyers. She originally only asked for her medical bills to be paid.

As for the real issue: if you have custody of someone you are responsible for their well being. It doesn't matter anything else. You, as the custodian, have to prove that you did what was necessary while they were in custody. Should you fail in that duty you are liable. Now there can be arguments of comparative negligence in the cases of some of the other deaths that have happened, but in the end because we are taking custody of these people and children in particular any failure to care for them appropriately are on us, not on the people who came here. We don't have to keep them in custody after all.

Me, I'd prefer to have a immigration system that holds asylum seekers for the minimum amount of time because we are able to process their cases fairly so fast that they are accepted or denied in like a week. That way we'd do our duty to our commitments and weed out the people who are just economic refugees and thus not eligible to enter this country. If it takes someone 6 months to be processed, that means we aren't funding the courts enough.

 

Especially when one of those other countries is the good ol' US of A, which can do no wrong? Lighten up BG?? We're all here to discuss?
