The DOJ has declined to charge Biden, in part, because he is apparently too incompetent for a jury to convict.

Does anyone see anything wrong with that being a determination, but the 25th amendment not being invoked?

 

Yet somehow Biden keeps winning and running the country much to the chagrin of this obviously tainted special prosecutor and the MAGA faithful out there. Its amazing isn't it?

 

Given the assessment of the special prosecutor, it would seem incumbent on the cabinet to invoke the 25th amendment and ye haaa.... Dems get a twofer, first black female (sort of) president who will lose to any candidate.....

Well, you cannot charge or impeach a sitting president who could possibly have dementia. I cannot say for sure he does only that he sometimes makes many mistakes. I really don't think he makes any decisions, but is probably a committee that works with him to make decisions.

Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.

Thereafter, when the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that no inability exists, he shall resume the powers and duties of his office unless the Vice President and a majority of either the principal officers of the executive department or of such other body as Congress may by law provide, transmit within four days to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office. Thereupon Congress shall decide the issue, assembling within forty-eight hours for that purpose if not in session.
