    The Law Hinges on the Idea of an Invasion or Predatory Incursion

    Historically, the Act has been used only when Congress has declared war, and Supreme Court precedent has acknowledged that the law may only be used as a wartime authority. But its text also includes actual or threatened “invasion or predatory incursion” by a foreign nation or government. There is, of course, no military invasion or incursion occurring in the United States, so it would be unlawful for Trump to invoke the Act.

    Nonetheless, invasion rhetoric has been a lynchpin of Trump’s presidential campaign. During a nomination acceptance speech at the Republican National Convention, Trump falsely claimed that the “greatest invasion in history” was happening at the southern U.S. border with Mexico, and such rhetoric has been used to justify his extreme anti-immigrant stances and policy proposals. Increasingly, we’ve seen other anti-immigrant extremists use “invasion” theory to facilitate their illegal actions. In Texas, Governor Greg Abbott has repeatedly claimed an invasion at the U.S.-Mexico border to show just cause for the entirety of Operation Lone Star, an anti-immigrant border enforcement scheme that allows for the arrest of U.S. citizens and others far from the southwest border. Abbott has even used it to justify the construction of a 1,000-foot barrier in the Rio Grande River.

    The problem for those opposed to trump on this (a majority of Americans are) is his SC routinely ignores established precedent to achieve ideological goals.

    That is exactly the problem. It's the path to a dictatorship. Trump won't care about the law. And the Supreme Court is likely to follow suit.

    This is in the hands of We The People. Protests! We will see many many protests. Grassroots protests! Nobody is going to protest for illegal aliens... But people WILL protest to uphold the law.

    One of the things the ACLU head said yesterday is he's hoping people take to the streets to protest trump's actions. Of course, they'll be under threat of attacks from the military if they do.

    Like they were facing threats of "military" actions the first time he was president and there were tons of violent protests?
    Time to snap back to reality.
    Obviously Trump is gonna get lots of opposition. and thats when he's gonna be like "OK, it just went from 5 million deportations to 10 million".

    They will be. And if they commit violent acts, they will be imprisoned (as they should). But it's the way people have fought for justice for centuries.

    The law does not depend on people's opinions in order for it to be a law.

    If you are in the nation illegally then the laws allow for your removal

    Well of course. A path to citizenship is always going to be preferable over mass deportations.

    The problem is, until the border is secure, discussing how to deal with 20 MILLION ILLEGAL MIGRANTS already in the country is pointless.

    It would be like deciding what color to paint the den before you put out the fire that is destroying it.

    Secure the border.
    Make it unattractive to come here ILLEGALLY.

    Then we can talk about how to sort out 20 MILLION human beings who are here ILLEGALLY.

    Dry up the jobs. Easy peasy. We could fix this problem in one day if we punitively fined companies who hire illegals. One large fine for one large company should do away with hiring illegal immigrants.

    Will we fix it by taking super easy measures? Nope. Wanna know why? The people who own their own Congress creatures like cheap labor.

    That was a provision of the 2013 immigration reform bill the Senate passed in bipartisan fashion. The one the original orange man, Merlot swilling John Boehner, refused to bring to the House floor for a vote.

    The easiest part of immigration reform is the job aspect.
    Bond visas, including work visas. People seeking work in the US aren't always looking for citizenship, they want the work. Let companies hire, bond the visa, and be responsible for transport, and when the job is done, getting them gone.

    Along with this, require ALL jobs go through e-verifile screens for all jobs, severe penalties for companies hiring without using e-verifile, and immediate deportation for ILLEGAL MIGRANTS.

    Problem(s) solved.

    Oh, and the part about employers wanting ILLEGAL MIGRANTS for work? They want reliable labor. Hiring foreign IF LEGAL is fine with employers.

    Ya me too, Italy and Yugoslavia my great grands from both countries didn't think much of Germans at the time. After Ellis Island they, Mothers grands were located to Wyoming to work coal mines, Father's were located to Chicago to work steel mills..

    So what's your point? My great Grand fled to the U.S. to escape the tyranny of Germany..

    What do they pay, like $50? We need punitive measures, something that really hurts, like $250,000 per person or something. Make it so that it’s SO painful, it won’t happen.

    This will never fly. As I’ve said, the Congress Creatures are bought and paid for by big money, who loves themselves some cheap labor.
