    Who was responsible?

    As Madame Justice Louise Arbour pointed out, the indictment handed down by the International Criminal Tribunal for the Former Yugoslavia (ICTY) in May 1999 marked the first time a sitting head of state had been charged "during an on-going armed conflict with the commission of serious violations of international humanitarian law." On May 27 1999, the Tribunal announced the indictment for war crimes in Kosovo of Slobodan Milosevic, the Yugoslav president until he was overthrown in October 2000; Serbian President Milan Milutinovic; Yugoslav Deputy Prime Minister Nikola Sainovic; Dragoljub Ojdanic, Chief of Staff of the Yugoslav Army; and Vlajko Stojiljkovic, Serbian Minister of Internal Affairs. All were charged on "three counts of crimes against humanity and one count of violations of the laws or customs of war" (ICTY press release, May 27 1999). Massacres and other atrocities at Racak, Bela Crkva, Velika Krusa, Mali Krusa, Djakovica, Crkolez, and Izbica figured in the indictment, with 340 individuals given as the preliminary list of victims -- overwhelmingly men who had been summarily executed.

    The specific charges against the four Serbian leaders are that they conspired to commit:

    1. Murder, a crime against humanity, punishable under Article 5(a) of the Statute [of the Criminal Tribunal], and also a violation of the laws or customs of war, punishable under Article 3 of the Statute (namely a violation of Article 3 common to the 1949 Geneva Conventions);

    2. Persecutions on political, racial or religious grounds, a crime against humanity pursuant to Article 5(h) of the Statute [of] the Tribunal; and

    3. Deportation, a crime against humanity, punishable under Article 5(d) of the Statute of the Tribunal.

    Many others in the mafia-ridden Serb regime played a crucial role in planning and perpetrating the atrocities in Kosovo. Down to the operational level, Yugoslav military commanders stood by as the notorious paramilitary forces, who had done most of the gendercidal dirty work in Bosnia and Croatia, were sent in to "cleanse" and destroy Kosovar communities. In many ways the strategy was that adopted, on a far vaster scale, by Nazi forces towards Jews, Soviet males, and others on the eastern front during World War Two (see the case-study of the Jewish holocaust). In both cases, the measures were designed to allow the regular military to maintain something of a "hands-off" approach to the worst of the atrocities, while still ensuring that the crimes were carried out. It is an important feature of the Tribunal indictment that Yugoslav Army Chief Dragoljub Ojdanic is among those accused of war crimes in Kosovo, just as recent scholarship on the fate of Soviet POWs and Jews has increasingly tied the regular German army to the genocides committed against those groups. The chain of responsibility for genocidal and gendercidal actions in Kosovo therefore extends from the Serb leadership down to the paramilitary units that carried out the murderous commands, and the regular army officers who looked on approvingly.

    At the time of writing, it was unclear whether the Tribunal's indictment would be extended to include the charge of genocide. In the view of Gendercide Watch, the indictments should be aggressively pursued, and broadened to include the genocidal actions of the Serb leadership in Bosnia between 1992 and 1995.

    In October 2000, a huge mass movement succeeded in toppling President Milosevic from power. His successor, Vojislav Kostunica, became the first Serb leader to acknowledge guilt for the genocidal atrocities inflicted upon Bosnians and Kosovars, stating: "as a Serb I will take responsibility for many of these ... crimes." Shortly afterwards, however, Kostunica issued a statement claiming he had been misquoted (see "Kostunica Denies He Admitted Serb Atrocities in Kosovo to CBS", The Chicago Tribune, October 27, 2000.)

    The Srebrenica Massacre, also known as Srebrenica Genocide, was the July 1995 killing of an estimated 8,000 Bosniak males, in the region of Srebrenica in Bosnia and Herzegovina by units of the Army of Republika Srpska (VRS) under the command of General Ratko Mladić during the Bosnian War. In addition to the Army of Republika Srpska, a paramilitary unit from Serbia known as the "Scorpions" participated in the massacre.
    The Srebrenica massacre is the largest mass murder in Europe since World War II.[7] In the unanimous ruling "Prosecutor v. Krstic", the Appeals Chamber of the International Criminal Tribunal for the former Yugoslavia (ICTY), located in The Hague, ruled that the Srebrenica massacre was an act of genocide, the Presiding Judge Theodor Meron stating:

    By seeking to eliminate a part of the Bosnian Muslims [Bosniaks], the Bosnian Serb forces committed genocide. They targeted for extinction the forty thousand Bosnian Muslims living in Srebrenica, a group which was emblematic of the Bosnian Muslims in general. They stripped all the male Muslim prisoners, military and civilian, elderly and young, of their personal belongings and identification, and deliberately and methodically killed them solely on the basis of their identity.
    The Srebrenica massacre was also confirmed as a case of genocide in the ICTY judgement "Prosecutor v. Blagojevic " and in the International Court of Justice judgement "Bosnia and Herzegovina v. Serbia and Montenegro".

    The United Nations had previously declared Srebrenica a UN protected "safe area", but they did not prevent the massacre, even though 400 armed Dutch peacekeepers were present at the time. The massacre included several instances where preteen children, women, and elderly civilians were also killed. The list of people missing or killed in Srebrenica compiled by the Federal Commission of Missing Persons so far includes 8,373 names.

    Stop passing off misinformation as facts, we get it, you are desperate to be seen as the victim, not the aggressor. The fact of the matter is that you are in denial over Albanian ethnic cleansing in Kosovo. Nato to this day is supporting ethnic cleansing by doing nothing to quell the violence and turning to the other cheek as they militarize the border. They got what they wanted, a new military base.

    Is there any sane serb on this forum, to show some compassion or sign of regret for the terror and genocide their compatriots have carried out against non - serbs ?!?
    The time of Yugoslavia has gone, once for all... serbs will never live under the same roof ever ! They are paying the price for their genocidal policy against others !

    DaVinci is promoting ethnic cleansing and is obviously extremely bigoted which pretty much makes them worthless to engage in conversation with. This much is clear, so just ignore them, I did, its not hard.     My comment was not ignorant, i am a Balkanian and i know better, there is a very important historical reason nobody likes muslims in the peninsula . During Ottoman control muslims didn't paid any taxes and as a result the empire had no interest to force convert populations.
    Bosniaks , Albanians and Pomaks betrayed their religion and nationality for money and nobody forgets that . They are traitors and they should be treated like that.

    Just because you're from the Balkans doesn't mean your comment isn't ignorant. If you want proof look at DaVinci. You're right about the fact that these people did take the easy way out, but that doesn't give you the right to treat someone like (*)(*)(*)(*) on the basis of their religion and that was not what the conflict was about. Just to let you know I'm not blaming anyone in particular...I see things as they are.

    Davinci is a pain. He has been harassing the board for a long time with his albanian propaganda. Besides have you see the Al Quaida propaganda using Bosnia as a ploy how muslims were murdered? I sympathize with all of the victims in the bosnian wars.

    But if you are using their deaths as a political ploy for a greater albania agenda by getting super power countries to carve up real estate in your behalf, you are no better than karadzic or mladic....

    No this board has been keeping Davinci for a long time. And I am surprised he got this far to be on this forum. I haven't been in the forum for almost 2 years.

    And I see him still ranting on the same thread with his 1990s mentality. Everyone is sick of the wars and try to find some peace and connection.

    Everyone has what they got and should count their blessing "they are still alive after all these years".

    I just feel croats,bosnians and serbs should work together for peace and economic stability and build new nations that can prosper for the future.

    When someone wants to blame a nation for some "crime", we should look at the situation from all angles, not just the popular one created by the bribed news media.

    In the case of Yugoslavia, we should look at the motives of HATO, USA, & Israelis in supporting the Muslim assassins in Yugoslavia.

    We should also examine the actions of the CIA/Mossad in carrying out assassinations designed to divide Yugoslav society, and cause violent reactions that would fuel the agenda of the people who hate the people of Yugoslavia.

    Before 1991, the US and others were assassinating people in Yugoslavia to create a destabilization process.

    When they had isolated Serbia, they created the Kosovo issue, and under that pretext issued an ultimatum to Serbia to surrender everything to the very people who were working to dismantle Yugoslavia.

    When Serbia refused the ultimatum, the US, HATO, et al. began bombing the cities and civilians of Serbia.

    Watching President Slobodan Miloševi&#263; in the video was amazing and saddening. He was very good at what he did, like Napoleon or Hitler, but, he was terrible at building brotherhood.

    The part about the Communist Party Convention reveals that he refused to be conciliatory towards other regions and drove them out.
