    under the statute Trump is being prosecuted for. Early critics of Bragg's case may not have been aware of them. I bet Alvin was.

    Survey of Past New York Felony Prosecutions for Falsifying Business Records

    A core crime that the Manhattan District Attorney will likely include in an indictment of former President Donald Trump is “falsifying business records in the first degree,” a felony under New York State law (N.Y. Penal Code § 175.10). Prosecutors and indeed all of us are compelled by the rule of law to consider how such a charge compares to past prosecutions. Are like cases being treated alike?

    Here it appears they are. Prosecution of falsifying business records in the first degree is commonplace and has been used by New York district attorneys’ offices to hold to account a breadth of criminal behavior from the more petty and simple to the more serious and highly organized. We reach this conclusion after surveying the past decade and a half of criminal cases across all the New York district attorneys’ offices.

    So the question then becomes; who did Trump intend to defraud by mislabeling the hush payments to Stormy Daniels?

    That doesn't change the facts of the case and the facts are the misdemeanor charges have expired and there's no Federal felony.

    The case presented before the courts of New York, as presented, are a felony. Prosecutors will have to prove them. But a misdemeanor is good enough to keep Trump stowed away while Fanny Willis and Jack Smith get their turn.

    Some of the charges would have been misdemeanors on their own, but as with many other criminal indictments, related misdemeanors are combined into felony charges. There us nothing unusual, or unfair, about the process.

    Asking for your legal credentials is fair game, since you opened that door with your posted claim. If you think others should not be allowed to challenge you, you're in the wrong damn place.

    The statute of limitations for fraud in new york is 6 years.
    Trump was indicted in April, 2023.
    The allegations involve payments in 2016 and before.

    The states claim (to get arount the statute of limitations) is that it is an ongoing criminal enterprise.

    It is not illegal to pay someone to shut up.
    Not even in New York.
    It is a weird stretch to argue those hush payments were campaign contributions. Trump contributing to trump .....
    And which tax laws?? The states case is that trump tried to hide the hush payments by paying his attorneys and calling them legal fees.
    Now, if his attorney in fact did pay stormy, and if trump reimbursed the attorney and called them legal fees, how is that tax evasion?

    So, you recall that hillary clinton paid for the steele dossier through her law firm, perkins coie and called it "legal fees".

    Other than trump allegedly paying stormy to shut up while hillary paid a foreign agent to cook up lies about trump, the scenarios are legally similar.

    And guess what?
    New york had jurisdiction and never prosecuted hillary.
    She was only fined for misreporting campaign funds.

    What a democrat does is politics.
    What a republican does is criminal.

    Paying a law firm for the investigation of a political opponent and calling it legal fees is perfectly legal. Many law firms perform deep background services. It wasn't a payoff.

    Trump is not be charged with paying somebody to shut up.

    It's illegal to falsify the accounting records, whether it's to pay someone to shut up, or pay someone to buy a six-pack of beer at the local 7-11. And when you pay somebody to shut up and falsify accounting records in order to influence voters, that's a felony.

    He paid more than $130 K to Cohen. $130 K is the amount that went to Stormy. The rest was to pay for Cohen's tax liability over those $130K. That's illegal in New York when it's done to alter accounting records and influence an election.

    I didn't make up the laws, I just think everybody (or as many people as possible) who violates them pays the consequences. I own a business and I don't violate tax laws. And it's a real PAIN for me to take great care to not violate them. I once accidently paid for a six-pack of beer at a 7-11 with my business credit card, and had to call my accountant to ask how to fix that so I don't do anything illegal. So why should Trump get away with it?

    I answered your questions, now answer mine. WHY should Trump be above the law but not me? Do you believe he's some sort of Orange Deity, or something?

    What is the name of the law school you graduated from? If not a federal felony then how is it Trump's lawyers haven't succeeded in having this case thrown out of court? Are they just really bad lawyers?
