There has to be a crime committed for there to be leniency given on a resulting action.

It isn’t a crime to have sex with a person younger than you as long as they are over 18 (16 in some states). It isn’t a crime to lie about your race, attractiveness, wealth, age, gender…

How is one of the above a mitigating factor but not the rest?

But this is a black and white issue. Murder is murder, period. To even phantom trying to downplay it over something like this is beyond me.

And now the rest of the story...

Former Virginia Tech football player Isimemen Etute found not guilty in death of Blacksburg man

CHRISTIANSBURG, Va. -- Former Virginia Tech football player Isimemen Etute was found not guilty of all charges Friday in the beating death of a Blacksburg resident following an online catfishing scheme.

Etute, a Virginia Tech freshman linebacker at the time of the incident in May 2021, had been charged with second-degree murder, which carries a sentence of five to 40 years, and the jury could have convicted him on the lesser charge of voluntary manslaughter. Instead, the jury believed a self-defense argument that Etute feared for his life after seeing the victim "make a reach" toward his bed where a knife was later found.

It still sounds like murder to me.

During testimony Thursday, Etute said he entered Smith's apartment alone -- both teammates waited outside and were not charged with a crime -- and engaged with Smith on a bed. Etute said he "felt around" and used his cell phone's flashlight to determine Smith was not a woman. Upon confronting Smith, Etute testified that Smith grabbed at Etute's genitals, causing Etute to strike Smith in the face with the back of his hand. Etute testified that he then believed Smith reached for a weapon under his bed, causing Etute to strike Smith with a fist several more times.

During a police search of the apartment, a knife was found between Smith's mattress and box spring, but Etute testified he never saw the knife, and he did not mention any concerns for his own safety during his initial police interview on June 2, 2021.

Ironically racial politics may have likely played a factor in the verdict.

Sometimes a broken clock can still be right two times a day.

In my opinion, this creepy white man took advantage of the black teen.

I don't think trans panic is a thing do males having sex with each other is homosexuality so it would be gay panic.

I would consider it rape for a trans woman to lie to a guy and make him believe that she really is a woman. Just like how you considered rape if a guy lied to a woman and said he was a woman and tricked her into some sort of lesbian encounter only to pull out the trouser snake.

I don't care if you say you're a trans or not lying to somebody to trick them into sleeping with you it is really deep gray area.

That's as may be, but it's one that happens all the damn time. "Yes! I really do love you." is one used quite commonly.

This is actually yeah and you better believe when it happens to women they try to make it out like they're being taken advantage of or even raped.

It's okay to do it to men because they are objects to be objectified
