    Trump was NY resident and state laws prohibit making a false entry in the business records claiming the payments were for legal services that were never rendered.

    It states
    4. The term "public officer" as used in this article shall be deemed to apply to any person who holds an elective or appointive office of the state, separate authority or any political subdivision of the state with authority to supervise other personnel within such subdivisions. The term "public employee" shall be deemed to apply to all other personnel of the state or such authorities or subdivisions.

    Doesnt apply to Federal elections. Like I said

    Falsifying Business Records in the First Degree occurs when you violate any of the four subsections of the lesser misdemeanor offense
    and an Assistant District Attorney can prove beyond a reasonable doubt additional elements. Coupling to the crime of New York Penal Law 175.05, prosecutors must establish that your intent to defraud involved further criminal intent to either hide the commission of another crime or to assist in the commission of that other crime. Because of this additional offense requirement, it is routine practice for prosecutors to charge potentially more serious transgressions alongside a Penal Law 175.10 case at the time of arrest or when the matter is presented to a Grand Jury.     Federal Election Commission already looked at this and determined they were not bringing charges. Trump and Bidens DOJ looked at it and never brought charges.
