What do you mean here you go? What you are looking for is a report that went to a vote in the UN General Assembly from one of their dept heads that did not go thru. What you posted has got nothing to do with nothing.
Juan doesn't make any determinations of guilt and definitely has no authority to impose "punishment." Detectives don't determine whether or not someone's guilty, that's for the Judge and Jury to decide. Do you see the difference? Juan isn't the one who interprets the law. When the UN takes action against the U.S. for these so-called violations we can talk. Plenty of people have accused and "investigated" the U.S. for war crimes but we've yet to see any kind of meaningful international court find them guilty of anything.
No offense, but...DUH. The military is not stupid. They are not going to do anything they can not get away with in a high profile case like this. I don't give a rat's buttocks what is standard in the U.S. military. I don't care if Congress agrees with you or not. I don't care if your own personal God him/herself told you personally that it was okay. I don't care if the entire U.N. stood up and applauded America's efforts in this matter. It's wrong. It's weak. It's cowardly. And if in your heart you do not know that - then you are but another ignorant, trained minion. Doing whatever the government tells you to do. Believing whatever it tells you to believe.
Solitary confinement is weak, cowardly, and wrong? I feel the complete opposite. Since you say you don't give a rats ass about any official legal entity's viewpoint, it all comes down to semantics and each individual beliefs. Unless of course you think that DA60's moral code is the gold standard by which to police the 6 billion human beings on earth. You're little rant may seem noble but its completely idealistic. The guy you are trying to dismiss obviously knows about torture as he was imprisoned and tortured under Argentina's military dictatorship,you know the one the Americans were friends with.
Holding someone in solitary confinement without trial for as long as Manning has been held is weak, cowardly and wrong. I feel that way about Manning. I even feel that way about that scumbag Staff Sergeant that killed 16 Afghani's (assuming he did it). I'll take noble and idealistic any day over 'the ends justifies the means'. I don't follow rules OR laws I do not agree with unless I have no realistic choice. And I NEVER trust ANYTHING the government says...they have to prove every single thing they say and do with unbiased sources before I believe them. America is about freedom - not subservience to the government...the people ARE the government. And if America does not pull out of this cowardly, un-moralistic, whatever-we-do-is-justified tailspin it is in...then I hope America ends and a new republic begins in it's place.
Why is this rather specious comparison between Manning and some as-yet-unidentified soldier being made ? We know or can establish pretty easily how many people the shooter killed, but may never be able to measure the lives lost ---because Manning wanted to enrich his sex life.
