Can you point me to Florida law that says *enumerated charges* can or can't be brought in at any time ?

It would depend on the evidence. Certainly it's plausible that a 66 year old could abuse a "minor", just as it's plausible that a minor could commit assault or battery on an adult. Presumably you would listen to testimony and look at the physical evidence to make a determination. If the adult has all the injuries and the minor doesn't, a child abuse charge would make the prosecution look stupid...and in this case it did.

 

Actually, and we should certainly hear this from O'Mara, the State's case for Z committing a felony assault is from DeeDee hearing sounds (Get off .... Get off) that would indicate Z attacking M. And that if the jury buys that as a felonious assault, then M2 (ill will, hatred, and depraved mind), or M3 (at least as the State wanted it, making M a "child being abused"), or Manslaughter all are/were on the table.

But that is the door that opens it up for them. That G assaulted or attempted to physically restrain M.

 

A sad note on our justice system is that it seems the system is more concerned with winning then finding the truth .

truthfully this case should never have gone to the jury based on prosecutorial conduct and withholding discovery but I am sure you don't want to discuss that either.
