One of the few absolutes we have that we know affect the unborn child ( there are a massive amount of chemicals and agents suspected of being teratogenic but little evidence that they are) is lack of vitamins especially the B group Folate and B12 So could a woman be charged for having a sub optimal diet?
If it's obviously extreme, so that any reasonable person should have known harm was likely to her developing child, then it could be argued yes. It's the same as if a woman feeds an infant a grossly sub optimal diet. That can amount to a form of neglect/abuse. Some women have been charged, or had their toddlers taken away from them by child protective services.

In the context of what we are talking about, that's a shocking statement. We are talking about a woman who overdoses on drugs to make sure that fetus doesn't enter into the world. I can't find any articles specifically telling exactly at what stage of gestation that baby died, but I'm imagining it must have been pretty late, otherwise she would not have been charged for it in California, a place which is very pro-abortion.

She apparently carried the child to 38 weeks so, in my view, she does owe that child life. She could easily have aborted the baby as abortion is legal in CA.
