    What is as written?
    All things written require interpretation. Especially years and years after it is written.
    And as years go by, so does societies views of the world.
    It was illegal for different races to marry, why? Because society thought it bad. Now it's a nothingburger to most everyone.

    Nothing can be kept as written forever. That's why there are infringements on arms ownership.
    So exactly as written seems to be a pipe dream and I would not be for that. That's why we have a court to continuously make rulings.

    When I was teaching, quotas came up whenever racism was discussed in depth. It was seldom a popular solution with students.

    The court can only make rulings on what the text actually says. They can't just waive a magic wand and make it say whatever they'd like.
    That power is reserved to Congress and the States through either of the processes described in Article V. Period end of story.

    No one accused Kavanaugh of rape.
    Both Barrett and Gorsuch were asked any number of relevant questions pertaining to subjects they may have to rule on..
    Unlike Jackson, they did not have to feign ignorance in their responses.

    That's why the assume a conservative court will do such things.

    Be honest - that wouldn't be enough of an answer for you. After all, during a vaginoplasty surgery, a surgeon creates both an outer and inner vagina by using skin and tissue from a penis

    Never mind she states, without hesitation or reservation tat Roe v Wade - an issue inexorably intertwined with, and dependent upon, biology - is settled law.

    'As a judge, what I do is I address disputes. If there's a dispute about a definition, people make arguments, and I look at the law, and I decide.'

    I'm content with that. Perhaps Blackburn should have posed a theoretical question rather than ask for a broad definition. But that would give away her 'gotcha'. Imagine us not knowing what she was doing...smh.

    As I’ve said before, if it was only about qualifications Biden could have nominated a straight white conservative man. That he didn’t proves it’s not about qualifications and all about agenda. Cruz, Cotton, Graham and Hawthorn asked about her agenda.

    I think the question was intentionally asked to whip the masses into a frenzy, as is being demonstrated in this 14 page thread.

    It doesn't matter HOW she answered. There was going to be a debate no matter what.

    Quite right - and I'm now sorry for my participation in the issue.

    What I find particularly sad is that Republican senators have attacked her on issues which are not in the purview of SCOTUS. McConnell has stated he would not vote for her because she would not take a stand on court packing. Strangely, Barrett also took the stance that it was not a SCOTUS issue, but he voted for her. Others attacked her on issues (like sentencing) when they obviously haven't looked in their own backyard about federal justices they've approved who have given sentences lighter than prosecutor recommendations in cases involving images of child sex abuse. Ted Cruz even freaked out about anti-racism books in the library where she is a trustee - but the school that Cruz' children attend have the very same books in their library.

    Yes, Dairy, that's why there are TWENTY-SEVEN AMENDMENTS to the Constitution! When there are valid reasons for the Constitution to be 'updated', we amend it, for that's the PROPER way -- and not to have some 'revisionist' judge making snap, unilateral decisions while 'legislating-from-the-bench'!

    Again, only CONGRESS may create laws....

    I actually agree with that as unfair as it often may be. When I was living in the shithole of the world known as Moreno Valkey, CA, I was paying a little less than $2000 in property taxes that went to a school system even though I had no kids. $2000 of my total property tax bill went to help people who didn’t take advantage of that help and turned my neighborhood, Moreno Vally Ranch, into what it was when I finally escaped - a dung heap of fatherless criminals who will break into and steal anything that’s not locked in a safe. One day my wife borrowed her father’s Porsche and parked in the driveway overnight. The little pecker heads not only cut the top of the roof in order to open the doors and steal everything that was inside, they also egged the car real good, probably with eggs they stole from someone else.

    Anyway, poor or people who are not affluent have no skin in the game even when the game is often suited to support them.
