About one third of the states are going to effectively ban abortions or already have. About one third are going to keep abortion legal no matter what. About one third of the states could go either way. Why are pro choice advocates so afraid to battle the issue out on a state by state basis?
Not afraid but basic a human right like bodily autonomy should include EVERY American. Ever heard of the UNITED STATES of AMERICA We shouldn't have to go to another state to exercise the right of free speech....or will that be next.
There is no such right in the U.S. Constitution. I believe the Supreme Court ruled that way a few days ago.
They obviously prefer fighting the centralized and deeply corrupt Federal government where they own the Deep State and can be pretty sure they can outmuscle any challenges. Fighting the Constitutionally envisioned Federalist system is obviously much harder and, like you said, they only have power over a third of the country. The NY Gun case and the Dobbs case are likely to be joined this week by a decision in West Virginia v. EPA which will likely obliterate the enviromentalists hijacking of the Clean Air Act to allow themselves the ability to regulate greenhouse gases which simply are not under any definition technically pollutants. Stay tuned, this could be fun. The mechanism behind the WV decision has the ability to destroy a great deal of regulatory law all the way back to FDR's New Deal (note- the Green New Deal will simply be stillborn). All we need now is for someone to make popcorn.
The question is.. is that what you want? Do you want to battle the issue out state by state? If abortion is a right, why is ok for some states to violate it? If the life of the unborn is a right, why is it ok for some states to violate it?
Why is a univerally applicable right the subject of popular vote? Would you permit your rights to be on the democratic (majority vote) chopping block??

Abortion isn't popular at all ... the RIGHT to make the personal decision, IS. We've tried outlawing the RIGHT to decide before in this country. It was failure - and that was a decision reached in a FAR more conservative country than the one we have now. This will be a short lived victory for conservatives. 5 years from now, when the only people prosecuted under abortion laws are the poor, we will be right back where we were in 1973.

It will absolutely be fought out at the local level - just as abortion was legal in a number of states before Roe, there will be a drive at the local level to get out the woman's vote. I'm already seeing posts on Instagram and Facebook from women who I hadn't seen any political discussion from before, suddenly posting angry posts against this ruling.
Terminating a pregnancy was always a tenth amendment issue. If people are angry, they must vote at the LOCAL level to make change.
So now we get to the nuts and bolts. How to enforce a law that encompasses a vague line between proving that a pregnancy was terminated naturally, or induced. The only way to do that is to FORCE a woman to undergo an invasive pelvic exam. What if woman says she will not undergo said exam. Will you force her to? Conservatives freaked about personal rights infringement when FORCED to wear masks - what are they going to claim when women are FORCED to undergo an invasive pelvic exam?
I still think you are overestimating the support for an abortion referendum and that's why pro-aborters are afraid to let democracy decide.

Never have met a "pro-aborter". In order for that to be a thing, people would have to be calling for ONLY abortion options in all pregnancies. Do you have examples of that? No. Didn't think so. Try again. As I said - there has never been big support for abortions - the support has been for the OPTION of being able to abort if that was the final decision of the woman involved.

Which will only ever apply in poor neighborhoods, cause the rich will simply take a "vacation" to somewhere it's legal. Which puts us right back to the original decision the Supreme Court made in deterring Roe in the first place - that the laws could not be equally applied.
