Abortions will now be resuming in West Virginia. After the Roe v. Wade ruling has recently been overturned, after 49 years, for a brief period of time the small handful of abortion clinics in the state ceased operation for fear that they might be in danger of prosecution. West Virginia still had a law on the books that mostly banned abortions, but that law was from 1882. Since the start of Roe v. Wade, the state had passed several other laws regulating abortion, which a judge claimed overwrote the old original law. Those later laws did not actually technically legally cancel the older law. But nevertheless, the argument can be made that the state should not be enforcing a law that was passed 140 years ago and has not been enforced for the past 50 years. With a state judge issuing an injunction stopping the enforcement of the old law, it now remains to be seen whether the state government will pass any new laws, now that they would not be blocked by the federal courts. West Virginia did not have any "trigger laws" in place (laws designed to take effect in the event the Roe v. Wade ruling was overturned).
A Pew research survey showed that 58% of adults in West Virginia believe abortion should be illegal in most cases, and 35% think it should be legal in most cases. The younger generation is more pro-abortion. Interestingly, those with lower incomes in the state are more likely to believe abortion should be illegal in most cases, and men are slightly more likely to be in favor of abortion than women, according to the survey.

Maybe they didn't have trigger laws because the 1882 law was in place. Poor decision made by the judge. I hate legislation at the bench even if it feels supremely compassionate to do so.

If the mother has to remove the baby because it was forcably placed there and it results in its death, charge the person who placed it there with child neglect and manslaughter charges, aka the rapist. It's their fault it had to result in a death. It's not the mothers fault for removing the child when she had no part in its being there, not even indirectly.
