Yes but look at the section on “reasonable force” that usually also applies

This disarms him and his right to use arms in self defense. That’s all arms including guns. It’s very much so a limitation on what would be in America (a right to bear arms)

The intruder was armed. I would be for sure it would be legal to kill him in my state

No it is anything up to and including bare hands. If someone suffers an untimely death that death is investigated and as part of that the prime person will be charged, however if it subsequently proves to be justifiable then the charges are often dropped. Sometimes it will go to court I.e. domestic qbuse

But you may be charged first until there is sufficient evidence for a determination of the facts to be made. Otherwise it would be all too easy to get away with murder by inviting an enemy into your home and shooting them

In most states-if someone breaks into an occupied house-or into a house at a time where the home is likely to be occupied, the law assumes the invader means to harm or is willing to harm the occupants. Meaning the occupants have the legal right to use lethal force to stop the home invader. NOW-if a BURGLAR (a different offense than ROBBERY) say breaks into a home during working hours, the authorities might not see that as justifying an occupant shooting unless there is additional indicia that the intruder means harm, rather than mere thievery. However, in my state, and most others, someone breaks into your home say between 6PM and 8AM, it's pretty much a given they are there to cause harm

that's almost as realistic as sending my trained unicorn to swoop down and gore them while they are playing quidditch

Yes the “I shot him so I am innocent” goes with the“good guy with a gun” myth

    Have fun petting the unicorns!

you really want to embarrass yourself by arguing with me over the American legal system and the concept of armed self defense?

I do not know Canada's laws, they may have a self-defense defense as well, have to watch how this case turns out

that is what it looks like, and maybe he has to prove self-defense, which in a case like this should be easy enough

I have, and if the choice is between me, my wife, child, or anyone I know getting shot in the face and shooting an attacker in the face, I know what my choice is.

They decided their life was worth less than the TV, not me.

And unless you're a mind reader, you don't know what their intentions are when they kick in a door.

I have seen a bunch of cases of gunshot wounds. at typical home shooting distances-birdshot is probably the nastiest thing to hit someone with. Now I never recommend it for self defense since the range is very limited . But at ten yards-which is far longer than the average home shooting-its absolutely brutal

Yeah we saw that during Covid with the police choking women out, pile-driving old women, and making you use facial recognition before leaving the house.

That is the seminal point that the criminal defense lobby seems to ignore. They whine that the life of a thug is worth more than say something you may have worked years to obtain. Sorry, I disagree. I will almost always side with a homeowner and what he worked for over a thief and I lose no sleep when a thief loses to a homeowner

Yeah at the surface level I'm sure it would shred the skin/shallow muscle, but there is no real penetration to the vital organs you need to hit.

I don't know about that-a facial hit at ten yards is almost always going to be instantly fatal. same in the stomach or groin. I remember watching my father put a load of #6 birdshot into a pretty good sized shark at about 8 yards. a shark bigger than the average crack head.
