What should it be called then? The unlicensed dealer loophole? The Biden Administration is enforcing a law that was passed with bipartisan support back in 2022. It amends the Gun Control Act of 1968 which said that dealers who sell guns "with the principal objective of livelihood and profit" must be licensed. That phrase has been replaced with "to predominantly earn a profit". It's estimated that 20,000+ more dealers will be required to get licensed. The guns used in the Columbine shooting were purchased at a gun show from an unlicensed dealer. Background checks should be universal so this is definitely a step in the right direction.
Do you think it would be a good idea to have a prescription drug show where unlicensed people could sell OxyContin pills to people who presented no proof of having a prescription?
well unfortunately for you, I actually understand this subject inside and out 1) almost every criminal who is denied a purchase due to a background check was someone with an old record-often drug offenses that have been subsequently de-criminalized or draft evasions etc 2) most criminals get guns from people who know they are criminals 3) without complete registration, the government cannot enforce this new "law" and the people most likely to get caught are the ones least likely to be supplying felons 4) until straw purchasers are hammered, this technique will continue to supply felons with guns the main reasons for this change are 1) so the Biden administration can pander to stupid people who think this is doing something 2) to create a demand for universal registration 3) to turn into felons unwary or ignorant people
"Unlicensed dealers who do not conduct background checks are also the largest source of firearms that are illegally trafficked into our communities. In an assessment of its gun trafficking investigations from 2017 to 2021, ATF identified sales by unlicensed dealers as the most frequently used gun trafficking channel." https://www.whitehouse.gov/briefing...-firearm-background-checks-to-fight-gun-crime Straw purchases from FFLs are a big problem too. Gun registration and limiting the number of firearms a person can buy within a certain timeframe could discourage such purchases. Gun registration would make buyers accountable and stopping bulk gun purchases would make gun trafficking less profitable.
that's complete crap because they count as unlicensed dealers black market sellers who know they are selling stolen guns to felons.
All great ideas. America has enough death from firearms. We don't need all these unregistered firearms.
There is no gun show loophole it won't do anything. I'm fact the Brady Bill already did this Biden is just pretending. The ATF=KGB They delight in murdering children that's like their favorite thing to do. Also mirroring mother's while holding babies. Why would you trust anything this org does or says?
at murdering children but nothing else They love murdering children why trust them. And their is their track record at being completely incompetent hence the murdering of children.
Never trust the Whitehouse when they are talking about usurping freedoms they'll sell out their own mother to get you closer to a prison or grave. Why would I be worried about him owners when the government is more likely to kill me?
That Steve Dettelbach is a sharp guy, and the Director of the ATF. He is the expert! Not you! That statement in the second paragraph below embodies the way that most common-sense Americans feel. https://www.cleveland.com/news/2024...nveiled-by-atf-director-steve-dettelbach.html Gun show sales loophole to be eliminated under new rule unveiled by ATF Director Steve Dettelbach Dettelbach, a former U.S. Attorney for the Northern District of Ohio and Democratic Ohio Attorney General candidate, said more than 40,000 people in the United States died from gun violence last year. He said his agency is trying to reduce those numbers by taking the “trigger pullers” off the streets, and stopping them from easily obtaining firearms. “As an American and as a dad and as a career prosecutor, it bothers me when some people follow the law, and others ignore it with no consequences,” Dettelbach told reporters. “That’s not good for the rule of law. It’s not fair for law abiding people. And moreover, when it involves repeatedly selling guns for profit, without running a criminal background check, it’s not safe for innocent, law abiding Americans.”
There's no gun Show loophole if this person is an expert he would know that if he's claiming that there is a gun show loophole he is discredited. Sorry this doesn't exist it's a fabrication like an assault weapon or a ghost gun. Bet your money he believes in that nonsense too. And if he does it further discredits him.
He's a democratic hack who is either a liar or stupid or both. there is no gun show loophole. If he doesn't know that, he shouldn't hold that office. He was selected because he's a gun banners
well when an ATF agent claimed illegally converted to full auto Glocks were weapons of "mass destruction" it proved to me that that agency is full of hacks and those who couldn't get hired by the FBI, DEA, SS, USMS or IRC CID
They operate secretly to assassinate people who aren't loyalists. Ruby ridge for example. That's KGB stuff.
Lol that's not a new rule. That's been a rule since prior to Obama ffs, and Obama clarified it still further. I can and will still go sell a gun privately to obtain funds to increase or change my collection. This is a lawful purpose. This is not a predominate motive of profit. And I can do it as many times as I continue to change or increase my collection IE every time. In fact: There is a gun show this weekend, and I'm going to go ahead and sell several items from my collection and turn the resulting cash into different items for my collection. Every time you mis-state the law in this thread, I will add an item.
Guns should not be sold for profit, without running a criminal background check, it’s not safe for innocent, law abiding Americans.
Perhaps it would be helpful if people like @Turtledude were to clarify what restrictions on gun sales they support. Should anyone be able to buy any gun they want no questions asked? Maybe they favor a "don't ask don't tell" policy when selling guns to people who may have a criminal background.
this is a rather well written in depth discussion of what the Bidenites are trying to do much of it violates established case law and federal statute https://reason.com/volokh/2024/04/19/second-amendment-roundup-atf-redefines-engaged-in-the-business/
Oh, an article by Stephen Halbrook- the NRA lawyer who couldn't figure out that Patrick Henry was advocating a state power to arm the militia rather than an individual right when he spoke of the importance of every man being armed. As for the recent change to the GCA, the Second Amendment does not protect a right to sell guns. Deal with it.
