I wonder if a single Democrats wants justice for this citizen? Honestly, I am calling out Democrats to explain their outrage over this IRS event. My outrage is we all get swept up in laws made to nab drug king pins. Who has deposited under $10,000 when you have more, so you do not get hassled by the IRS? This man lost his company. Had no cash to pay workers. His wife died. And the IRS kept his money? Are they broke?
This kind of stuff happens all the time and is the result of Republican "get tough on drugs" policies from the Reagan administration days. We obviously don't know all the facts here, but under forfeiture laws passed in those time periods, the Govt can seize cash and money with just a minimum "probable cause" to believe it was illicit or related to drug trafficking. The the putative owner of the money has to prove that he is an innocent owner of the money, which involves hiring a lawyer. For this guy's $59,000, it's worth. For the many thousands of cases where the amount is less than $10k, its generally not. This kind of thing has happened many thousands of times over the past few decades. I agree its kind of outrageous.
Some blame republicans, yet is that actually the right group to blame? No matter who created the law, it is draconian. First the owning of cash is legal. If it is in your pocket, it is legal. If it leaves your pocket and lands in your bank, that may even make it more legal given it is done in the open. You can't deposit cash in the bank in secret. It takes parties to snitch to the government that the money, good for all debts both public and private, to tell the government. What takes place here is the presumption of guilt. I believe if we were to blame politicians, and clearly they deserve the blame, chances are far greater this is a law imposed by Democrats. I can look up who created the law, and it might prove me wrong, but since 1932, Democrats have created far more laws than have republicans. Democrats solutions are always couched as making up laws. https://www.washingtonpost.com/news...re-smurfin-ridiculous/?utm_term=.742d97eda0c6 The story must be told.
That was the law that was allegedly the legal violation, this article discusses the framework of how such money can be seized which a criminal charge or finding of guilt under civil forfeiture laws. https://en.wikipedia.org/wiki/Civil_forfeiture_in_the_United_States
The IRS is nothing but a private collection agency for the private bank owned Federal Reserve and it's illegal issuing of USA currency and coinage WITH INTEREST. This is supposed to be the responsibility of the Federal government treasury department without interest....President Kennedy tried to make the switch back to constitutional money, but a few months later he was murdered, just like Lincoln, McKinley, Garfield before him...
Why don't you try researching it on the web and in books...learn the truth, that is if you are interested in learning the truth.
If the man has a good case, and it sounds like he does, he should get in touch with Institute For Justice. They have fought and won quite a few forfeiture cases like this.
