    If your social media presence can be traced back to your employer, then yes, they have that right, more so if you go viral.

    OP is the one who brought it up though, not me. Anyway, my first post in this thread was asking him would YOU want a neo Nazi working for you? I know for damn sure I wouldn’t.

    That is true in at will states, but you also need to consider the cost of hiring a replacement if you fire someone or the cost of no expansion of the business because no one seems to be doing that work either. So, it may be a choice per se, but you need rational reasons for letting someone go. Certain industries and businesses have high replacement costs, and to minimize costs, businesses will not let people go unless there is no work to be done, a negative cash flow for instance, the person is completely incompetent and has been given several chances, or has had certain legal issues that may put a negative image on the company, or bad advertising that the company does not need.

    There are some companies that require to list your social media names on the application, especially if you are in customer service and are meeting face to face with customers.

    Most of the other time, the application is already weeded out based on several criteria.

    If you're in a right to work State, one can be fired for wearing the wrong color clothes to work.
    There's no laws protecting workers. One MUST follow company policy. Period!!!!

    One can be anything they want. An employer also has no obligation to employ anyone they don't want.
    Unless there's a union.

    Private owners/corporations can waste money on firing employees over moral reasons but public corporations are obligated to their shareholders and corporate manager shouldn't be firing profitable employees to enact their personal morality upon the workplace let alone the world outside the workplace.

    Nor would I want a marxist leninist asshat and for precisely the same reason but as long as either keeps their crap out of the work place it isn't my issue until they make it my issue.

    It's funny when the Been Nowhere Know Nothings try and make out that the "Left" have double standards by catching them out. They get caught out themselves.

    When I fired someone in the USA (two people actually, both executives with contracts and great healthcare coverage for twelve months after they got canned) I took legal advice. Very simply I was told to give no reason at all. Giving any reason whatsoever would risk a discrimination lawsuit, especially as inferences could be drawn by twisting words and applying it to circumstances (ie age discrimination, sex discrimination, racial discrimination etc.). Giving no reason, or in other words hiding my reason, was the safe legal course of action. Just "your fired clear your desk and we will honour your contract". For at will employees it was "here's a pay check now don't come back on Monday". Land of the Free!

    I was advised to do precisely the opposite of what I would have to do in Europe which would be to explain exactly why I was firing them and why it was a fair dismissal/selection for layoff etc... and what government mandated compensation I would be paying them.

    So the question is: should this "perfectly OK to hide the reason you are firing someone" be allowed in the USA? Now apparently America's neo-fascist American Firsters want protection against "unfair dismissal". What kind of European commy labour laws do these morons want the USA to introduce that interfere with an employer's right to hire and fire anyone they want for whatever reason they decide? What kind of employment protection laws do they propose? And how is this not the rankest hypocrisy on their part?

    For me I would copy the German labour law into Federal law. The answer to the equation would then be: "it's complicated", including whether you have brought the company into disrepute in some way, broken a Company policy or compromised your ability to do your job. Not going to happen but no double standards here.

    Given that American neo-fascist do not generally support the approach of liberal commy Europeans I ask again: if you don't like the current US law, what would you propose apart from employment protection laws as practiced in the liberal democratic world?

    Different strokes I guess, because I just don't feel comfortable working alongside someone who thinks people with slightly more melanin than them should be extinct.

    If you don't know it how would you know whether or not to care? If the dude is walking about the office wearing a Swastika and yelling Sieg Heil dude needs to move his act down the road. I also met a couple neo nazi back when I was in the Army that didn't care what color you were as long as you weren't Jewish. You got to remember here that we aren't talking people with just a whole lot of gray matter to spare at least not in my limited experience.

    Personally I think that’s worse if I’ve been working with a dude with a swastika tatted on his chest for years and never knew.

    In most red states you can fire anyone for any reason. It's ironically called "right to work".
