    ‘We will prosecute’ employers who help immigration sweeps, California AG says

    The state’s top cop issued a warning to California employers Thursday that businesses face legal repercussions, including fines up to $10,000, if they assist federal immigration authorities with a potential widespread immigration crackdown.

    “It’s important, given these rumors that are out there, to let people know – more specifically today, employers – that if they voluntarily start giving up information about their employees or access to their employees in ways that contradict our new California laws, they subject themselves to actions by my office,” state Attorney General Xavier Becerra said at a news conference. “We will prosecute those who violate the law.”

    Becerra said the state Department of Justice and the state Labor Commissioner’s Office plan to issue formal guidance to all California employers, public and private, notifying them of their responsibilities under a new state law called the “Immigrant Worker Protection Act,” signed by Gov. Jerry Brown last year that took effect Jan. 1. It seeks to prevent all workers, regardless of immigration status, from being detained at workplaces.

    Authored by San Francisco Democratic Assemblyman David Chiu, the bill:

    ▪ Requires employers to ask immigration agents for a warrant before granting access to a worksite.

    ▪ Prevents employers from voluntarily sharing confidential employee information without a subpoena.

    ▪ Requires employers to notify their workers before a federal audit of employee records.

    ▪ Gives the attorney general and labor commissioner exclusive authority to enforce new provisions of state labor laws.

    ▪ Prohibits employers from re-verifying information on employment verification forms, unless compelled to by federal law.

    Question:

    By threatening employers with fines and jail, and in effect creating a barrier to the efforts of Federal Law Enforcement actions, has California unilaterally established its own immigration law?

    Yes, they have established their own immigration law. That law is to resist the federal immigration laws.

    As a former business owner in California I can tell you that this new law is outrageous. I fully believe it establish unique immigration laws, which would be a violation of Federal Laws. Arizona proved that can't be done.

    An employer is subject to fines and imprisonment if they are found to have employed illegal aliens. However, the State of California has made it difficult, if not illegal for employers to correct any potential violations of those laws.

    Must be why California's unemployment claims went up this year.

    California’s estimated, unadjusted claims rose by 11,994 to 59,284, while in the United States, it's at the lowest since 1973.

    The Arizona thing raises an interesting point. That violation of Federal law was defended by many conservatives as States' Rights, while this violation is defended by liberals as protecting human rights.

    This shows that members of both parties are prone to abandoning their core beliefs if it is convenient for them to do so.

    Can't be done, Xavier Becerra falls under as one of the protective groups.

    Becerra is an anchor baby, a socialist and a nationalist who supports Mexico.

    Becerra is so far too the left even Bernie is nervous.

    California Democrats are focused almost exclusively on legislation which either has to do with wealth redistribution or creating new “rights” for alleged victims such as illegal aliens, criminals, union members, homosexuals, transgenders and other “oppressed” groups.

    California is setting up their own government separate and apart from the USA. They said they would. We stand by and let them. There will be 49 stars on the flag soon, and we will still help them and give them federal representation. We are all dupes and cuckolds to California, but Californians are the worst.

    Treason. He needs to be arrested, put on trial and executed if found guilty. You cant jail Americans for abiding by the constitution. Execution needs to occur in cases like this to set examples for the other leftists thinking about committing treason.

    Well, actually, if you go down that road, it's all the liberal/progressives in the California Legislature who passed the bills creating these new immigration laws, and Jerry Brown who signed it into law.

    Imagine the insanity of what California has done.

    It is a crime for an employer to knowingly hire a person not legally allowed to work in the United States. This obviously includes illegal aliens.

    If an employer is made aware an employee may be an illegal alien, California Law "prohibits employers from re-verifying information on employment verification forms, unless compelled to by federal law."

    Wouldn't Federal Immigration Laws be the only reason an employer would go to the trouble of re-verifying information? Would an employer risk fine and imprisonment by doing so?

    Which is worse, Federal fines and imprisonment if you don't check, or State fines and imprisonment if you do?

    This new california law may put some moderates who oppose the wall in a difficult situation

    They say we dont need the wall and should just pick up the illegals who they try to find jobs

    But that idea will not work in california
