Alec Baldwin: All criminal charges against actor over fatal shooting on Rust set are dropped

    No Alec Baldwin did indeed shoot someone in her life while making a movie.

    And cars in movies are in movies but they are cars and you still have to drive them safely. Just like firearms in movies or sometimes real firearms and you have to handle them safely.

    The court also dropped the charges against the armorer, too.

    Unless you're a famous moviestar. Then its OK to blame the bureaucracy ...and not hold that bureaucracy accountable.

    If it is loaded with blanks, how would your average person know? Shouldn’t that be the job of the armorer?

    A lot of things went wrong that day, the least of which was Alec Baldwin, the actor, practicing and shooting the scene. But that in no way makes him criminally liable. It makes him civilally liable. And personally, I think the movie should be scrapped in its entirety for all involved.

    So, if a person driving a car on a movie set has an accident and kills someone on the movie set, should they be charged with manslaughter even if all the precautions are followed? Be careful how you answer that one.

    I know the gun was real. The only fake guns used are the sci fi guns used in sci fi films and TV shows, like the hand held phaser for instance, or the blaster in 1978 Battlestar Galactica, among others.

    However, it is stil a movie set. The Firearms expert's sole job on the set is to make sure the firearm is safe to fire. The actor's job is to recite the lines and actions of that scene, even if shooting the gun with blanks. That is it. The actor is not allowed to do anything else, not even move the chairs sitting behind the camera.

    The actor does not get a free pass. Accidents do not mean it wasn't criminal. Involuntary manslaughter statute covers unintentional killings in New Mexico.

    Did the average person wouldn't if you're the average person without any knowledge pointing guns at people and firing them that's reckless.

    Why wasn't he absolutely certain both how to tell a blank from a life cartridge and that every single one of those cartridges in the firearm was a blank.

    If he did not care to learn what the hell he was doing and he pointed a deadly weapon at someone killed them didn't he's negligent learn about the machinery before you operated stupidity is never an excuse.

    Unless you're rich in sort of famous.

    Actually many movies are shot with guns that only fire blanks and will not fire a projectile. Automatic 'replicas' that fire blanks can be expensive, as the recharging system may have to be redesigned from the ground up to accomodate the lower barrel pressures that drive the next round to be cycled. But even those are already available in the more common firearms. Cops and military use versions that fire 'soap' rounds (think similar to paintball, but with a real powder charge) that are undersized and not capable of firing any standard ammunition that might accidentally make it on to the training ground. I've heard these excersizes called 'sim-munitions' and I've participated in them as 'the bad guy' before (lots of fun!). But a replica revolver that is incapable of firing a bullet is actually cheaper than a real revolver (mostly due to taxes and regulations- mechanically and materially, they arent much different) since revolvers don't rely on the gas pressure to cycle after firing. One has to wonder why Baldwin (or whomever is in charge of the movie's finances) decided to use a real gun instead of a functionally identical but non-lethal alternative...

    yeah mostly negligence and stupidity most of which was Alec Baldwin.

    He pulled the trigger without knowing anybody on day one of learning gun safety would know absolutely do not do that.

    I've taught gun safety to people before that's the first thing you teach.
    no his fading Fame is what protects him from being criminally liable.
    if he's at all smart and that's questionable at this point he probably has insurance so if you sue you're suing an insurance company. That doesn't mean that Alec Baldwin is in getting off scot-free.

    I don't think it was intentional I don't think he meant to kill somebody that day every time he shuts his eyes he has to see the person that died and they're crying family for the rest of his days because he was a moron. And I hate to say this but he deserves that. And I hope nobody ever works with him again because he cannot be trusted he'll kill you. He did it once before.
    Well what this would be equivalent to is somebody intentionally charging after a pedestrian in a car thinking that they can stop before they hit him but not knowing enough about cars to know the stopping distance and kill them. A person doing that would probably be a stunt driver and if it was a stunt driver they'd probably be sitting in jail for 15 years because they don't have the name recognition.

    Serious question: after this incident, do you thinks actors will get training on the guns they use for movies and double check the gun that was handed to them?

    Baldwin paid plenty financially for all the charges against him and there's also the settlement in the civil suit with the family of the deceased. His reputation has irrefutably been harmed. Hard to come back from something like this.
    Looks like justice has been served. He should probably just fade away now.

    When it comes to Westerns, even on TV shows like Gunsmoke, real guns were used. It always has been. The only difference is the type of ammo used. Blank cartridges are used. these types of rounds have a high smoke incidence than real firearm bullets most of the time. But the fact is even Brandon Lee succumbed to a gunshot wound while on set. It was tragic, but no criminal charges were provided even though it was in Georgia as the set. And similarly, the same thing happened in Rush in New Mexico. The two situations are so strikingly similar, it is almost unbelievable.

    With the US military and police, it is simunition that is used. But even if there is an accident and someone is killed on a military exercise with that type of munition, it is rare, unless with absolute intention, in which a soldier will be charged as well. The safety training officer would be disciplined with a reprimand, but that is it. No UCMJ will be used.

    Which is why I said Alec Baldwin is civilally liable, as the producer. He has multiple hats on this project you know.

    I think there will be additional safety protocols such as the movie, or any of its production staff, or the actors, will be allowed to bring any live ammunition to the set under any circumstances. I think that will happen first and foremost. Second, I think there will be additional safety protocols with the armorer who will now have to triple-check or quadruple-check the firearm for safety reasons, which adds cost, time, and money to the project.

    I would say if you're firing a gun and you don't want to slay somebody you're just an average person and don't know whether or not the cartridges in the firearm are safer deadly you don't fire it.

    I've been asked to operate machinery that I didn't know how to use and I said no I need to be trained first. That's what a smart person does and I think an average person is that smart.

    What you do if you're just learning about guns is you take the cartridges out of the revolver and look at them if you can't tell him by looking at them if they're blanks or life cartridges put the damn gun down with this minute set the ammo down of this minute and go find out.

    We live in the information age I'm betting I can Google how to tell the difference between a blank cartridge and a live cartridge and see.
    Wow that was so easy to find.

    Are you suggesting Alec Baldwin is too stupid to know that firing bullets at people could kill them? If that's the case it should be a federal crime for him to even be around guns.
