No... it wasn't. The southern states had already won in the supreme court over the expansion of slavery. The Supreme Court ruled that the federal government didn't have the right to require incoming states to be non-slaveholding as a prerequisite for entry. Which means any incoming territory that allowed slavery (which meant all of them), would become a slave state. That fight was already won.
Sure it was. As long as the supreme court said it was settled, then it was settled. They simply wouldn't continue hearing the cases. And within 30 years 10 more states were added to the union. With 10 more slaveholding states added to the union the fight was over.

The job of the supreme court is not to interpret the constitution according to their own morality or the morality of the time. It is to interpret the constitution as it was written given the facts of the case.
