Are there convictions for every murder? Does that fact mean the murders were not committed? Your logic wanes. The salient FACT was it was adjudicated as insurrection, and NONE of the judges AND justices contested the finding of fact by the lower court.

Smith didn't prosecute 'insurrection' because there was none, most likely because he couldn't get it done before the election.. Who knows, he might add it later.

 

There are not convictions for murder when there wasn't one. The salient fact is no one has been charged with such a crime ESPECIALLY Trump and your wishing he had been does not make him guilty of it. You don't speak for Smith, if you are claiming he didn't do something for a reason then PROVE, quote him saying so.

They prosecute based on whether or not they believe they can convince a jury beyond a reasonable doubt. Lot's of things are factored beyond the mere fact that the murder was a murder. There might be plenty of evidence murder was committed, but not enough evidence to convict someone.

You, nor the Special Prosecutor, nor the Jan. 6 Committee, nor the NYT, nor MSNBC, nor CNN, nor Woodward and Bernstein nor anyone else showed Trump inciting a riot. Please stay and post me the quote or video or Tweet that incited a riot and explain why on earth he would want to do so when it stymied his plans to legally challenge the voting, a challenge with little chance for success but a legal one nonetheless.

Tell me how was the riot suppose to facilitate Trump remaining in power and post the evidence that was the plan they were implementing. Once the guy in the wooly horned headress took the podium how was power going to remain with Trump by force?
