    A California man has been charged with felony assault, accused of shooting a Black man renting a nearby Airbnb property as he walked to a grocery store, in what prosecutors called an “unprovoked attack.”

    Mark Waters, 66, was charged with felony assault with a semi-automatic firearm resulting in great bodily injury and personal use of a firearm, the Santa Clara County district attorney's office announced Friday, two months after the Oct. 2 shooting in San Jose.

    Further charges may come, as law enforcement is investigating potential hate crime allegations.

    The 21-year-old victim had left his Airbnb rental to walk to a nearby grocery store on the night of the shooting, prosecutors said. He was unarmed.

    When he crossed the street, he saw Waters exit a home and “quickly approach him while holding a black handgun,” the district attorney’s office said.

    Probably. Why did he shoot him? Seems like we would have some sort of motive.

    Waters’ attorney, Jose Badillo, pleaded with Paul to allow his client to remain free, noting his absence of criminal history and standing in his community. Badillo also disclosed new information, which was not in the initial police reports, that Waters had experienced a car break-in a few days before the shooting in which his garage openers were stolen.

    According to a summary of the court hearing, Badillo told Paul that Waters thought the victim might have been one of the culprits.

    But Welsh said nearby home-security video shows that the 21-year-old man, who was staying in a neighboring house through Airbnb, never set foot on any part of Waters’ property and was simply walking to a nearby grocery store. Authorities say that when the man soon saw a gun pointed at him, he turned away and tried to retreat to safety but could not avoid Waters’ single gunshot, which hit the man in the leg.

    The guy sounds 100% guilty...attempted murder sounds right. Not 1st degree..maybe 2nd degree?

    Individuals like this are why white nationalists have been deemed the most dangerous threat the nation is currently facing.

    Let’s hope they begin to address the threat

    I am sure the charges will increase now that they have video, he thought owning guns would improve his life, some people ruin their own lives and others when they buy a gun - about ready to retire and enjoy life.... not now

    reality is, if he wanted to remain free, all he had to do is not pull the trigger

    because he bought the guns, he will now if found guilty find himself in a much more dangerous place... prison

    many can buy guns and are just fine, some can't control their temper without a gun, they should never buy one

    If the article is accurate and is not leaving anything important out, then of course it is a cold blooded murder. Maybe the white guy was on some sort of drugs (which would not be an excuse and he will still be punished).

    But I suspect there might be more to the story. Are we being told what the (surviving) man claims happened?

    Matt84, you're being absolutely absurd. Do you really believe anyone on the Right in this forum would think a white guy who shoots a black guy for no reason should not be charged?

    But maybe there is a reason, and someone like you would just disagree with it.
    I'm not going to jump the boat on that one though since right now we have no indication there was any reason.

    Here's one possibility, one way it could have played out. Maybe the white guy was staring at the black guy, the black guy didn't like the way the white man was looking at him, looking like he was suspicious and all, so the black man started reaching into the waistband of his pants as if he had a gun, trying to scare the white guy and make him (*)(*)(*)(*) off.

    I hate to speculate because there are all sorts of possibilities. If that possible scenario were true, then the white guy is out of luck, he should still be punished, unless they can somehow prove that the victim did that.

    If there was no reason, or there's no evidence there was a reason, then of course he should be punished for murder.

    Matt84, just to let you know, I defended that young male black guy who, while under the influence, stomped to death a much older white male pervert who tricked him into thinking he was a female to have sex with him.

    Not to go off topic though, but just saying.

    I apologize, sorry I did not see that post.

    If that is the only relevant facts to this story, then it sounds like the shooting was totally unjustified.

    Do you have a problem that he was released on bail?

    A completely innocent man who had nothing to do with this could have very easily lost his life for something he never did.

    Well, he was shot in the leg. So that is a tiny bit of an exaggeration.
    I'm not claiming being shot anywhere on the body is not very serious, but it's a little bit of an exaggeration to say it had a high chance of leading to death. To be entirely fair.

    That's probably the only reason he is being released on bail.
