    That actually depends on the state. If I'm not mistaken, the age of consent in NC is 16, for example.

    Yeah a lot of states have some sort of age gap clause that as long as one person is 15 or 16 or something then they can legally have sex with someone 5 or 6 years older than them, even if its over that magical 18 year old line.

    There is some truth to this.

    One of the worst abuses of statutory rape laws happened in Georgia.

    Overall, the flexibility of statutory rape laws unfortunately allows parents to apply prejudices against things like race to potential offenders.

    Thats because parents base their actions on the emotional attachment to their children, especially daughters. You will see many fathers running with the shotgun if their 16 year old daughter was dating an older man, even if its legal.

    I don't necessarily disagree with them. The law is the law, but it gets different when its actually your child.

    I could be wrong, but I believe the sliding scale here starts at like 14. Anyone within 4 years of a minor at that age can legally retain consent from him/her.

    The same applies for 15. 16 is where "anything goes" essentially.

    It needs to be done away with. Honestly if they are willingly and wantonly screwing at 12 what difference does it make if the guy is 17 or 70? It is a societal issue really. We make children do things they were not designed to do and if it were 200 years ago we would not be having this part of the conversation.

    It is not the past though and we lead by example. Everybody is (*)(*)(*)(*)ing and killing in the movies, the songs and even some toons. Moms bring home swinging dick after swinging dick and have sleep overs...

    More than anything, I think we need to better define the separation between adults and minors.

    For example, if you're a minor, you shouldn't be able to be tried as an adult for a crime.

    That being said, we need a better system in place to handle minors that commit heinous crimes, so that trying them as adults isn't necessary.

    Not all date rapes involve rufies.

    One thing to consider is that, legally, if a man and woman both get really drunk and have sex, the woman has a decent shot at accusing the man for rape even if they both were equally smashed.

    So, something needs to change in our system where men and women are actually treated as equals regarding this sort of thing.

    It's one thing if one person is really drunk and the other is sober, but if both are really drunk, then I don't see how it's a rape.

    Well, that's also an indication that maybe minors should have more rights than they are currently given, if they apparently have enough judgment to be treated as adults.

    It's not a very just system when the only time you're treated as an adult is if you commit a crime.

    Well the grey area appears when you discuss how you actually got the consent from the so called minor. A lot of these kids aren't little innocent kids and know full well what sex is and what they are doing. Some will argue that an adult has the mental capacity to encourage a weaker minded child into having sex through a number of means. But is this really any different than with adults? Men trick women into bed all the time by saying they love them. Society just deems it wrong to pull that same act on a teenager instead of another adult.

    Im not talking about actual children where someone can say heres a lollipop now do what I say. Im talking about teenagers who are far from stupid.

    Thats because society still looks at women as the vulnerable ones. Just like if a teenage boy sleeps with his friends sexy mother then he's going to get high fives. If a teenage girl sleeps with her friends handsome father then somebody is likely calling the cops.

    Its a double standard that protects vulnerable women more than men.

    That is very true. It's wrong that a "child" has the mental capacity to know right from wrong and will go to adult prison if they commit a murder yet their mental capacity magically disappears when it comes to being able to consent.

    Thats because many feminists who scream for equality are lying through their teeth. They don't want equality they want inequality with them coming out on top. Not all but many.

    Not for the phony date rape and statutory rape. Those who jump out of the bushes and grab women are the only real rapists. The only way to cut out such animal behavior is to cut their balls off. Who wants unfit fugitives from evolution to pass on their genes anyway?

    i heard a lot of stories in connection with the counseling / group therapy, and none of them were like that.

    So a man who takes a woman home after a bad first date, walks her to the door and pushes her to her hands and knees when she open the door, closes the door and sodomizes he is not a rapist?

    I think he was making the case about all violent rape of that sort, he used the bushes thing as an analogy of that I believe.

    I hope so. Most rapes are by a person who knows the victim.

    I view all rape to where the other person is unwilling or unable to resist to be equal. If someone drugs a victim and takes them home that is just as bad as dragging them into an alley and tying their hands up.

    Now the whole alcohol thing is also a grey area. I don't know if it should be legally wrong to take someone out to a bar or whatnot and go "shot for shot" with them to get them drunk with the intent of taking them home. Drunken consent is still legally considered consent. Now if that person blacks out then it's illegal to take advantage of them.

    Amendment 8 specifically protects against cruel and unusual punishment. Castration most certainly qualifies as cruel and unusual punishment.

    What exactly is the definition of cruel and unusual punishment? The definition is there but is interpretation is subjective.
