Democrats Are About to Lose the Federal Courts for a Lifetime

    Republicans hit a new milestone in their campaign to capture the federal courts for a lifetime. President Trump has now appointed over 150 judges to the bench, including one-quarter of all judges on federal courts of appeals.

    Let that number really sink in: One in four seats on federal courts of appeals is now held by a Trump appointee.

    These judges will decide on all manner of issues, from the constitutionality of near-total or total abortion bans, to the legality of efforts to divert federal family planning dollars to religiously affiliated clinics that do not offer contraception and abortion, to attempts to carve out for religious conservatives exceptions from civil rights laws that would allow them to discriminate against LGBTQ people. Unsurprisingly, these appointees are all conservative ideologues and mostly white men who will leave their mark on federal jurisprudence for generations.

    I think most judges appointed by Republicans or Democrats do an amazing job fairly and correctly interpreting the Constitution. I think very few uber partisan ideologues make it through.

    Let's look at some examples.

    Or an example as I am not that interested.

    John Roberts. Appointed by Bush. I recall sky is falling sort of rhetoric over the prospect of an uber conservative. I think the guy has done an amazing job to date, not taking any party line on anything.

    One can only go so far left or right within the bounds of the Constitution. I think activist judges are outliers bordering on fairy tales.

    I agree I think most federal judges uphold the constitution, but my gut tells me that far more conservative judges do it than liberal judges, we see that out of the 9th circuit court of appeals that I am unsure has ever heard of the constitution. As republicans the vast majority of us only ask that the constitution guides them not social justice whinery.

    Let us hope so... on both sides. The judge shopping often reveals those hyper partisans that put their ideology ahead of the Constitution. I wish the Supreme Court would review the extra egregious ones and toss those judges, but I don't think that would be constitutional either.

    Many of Dirty Donalds appointees were over the objections of the ABA as they felt they were not qualified.

    People don't go judge shopping because they don't have need for a guaranteed outcome.

    They railed against judicial activism. I'm not sure there are many activist judges.

    That is most troubling. Qualified judges are seldom a problem. The Supreme court in its current configuration is fine because these judges have a genuine love of the law. That is true of most of America's bench.

    Generally speaking I agree with you both on this issue ---- except for the ninth circuit, which illustrates that partisan ideologues do make it through, which I think we would all agree is problematic.
