Indeed it is when a Republican judge rules against the ban on same-sex marriage. That has to be sweeter than chocolate with strawberries and whipped cream on top. Indiana and Wisconsin's ban on same-sex marriage was struck down by the U.S. Seventh Circuit Court of Appeals. This Excellent article is well worth reading by all who wish to read some of what the judge said. The judge really hit the nail on the head therefore, nailing this situation.
So Indiana prohibits first cousins from marriage yet recognizes those marriages from other states? I thought that all states banning SSM were protecting the sanctity of marriage.
"If the state’s only interest in allowing marriage is to protect children, why has it gone out of its way to permit marriage of first cousins only after they are provably infertile? The state must think marriage valuable for something other than just procreation — that even non-procreative couples benefit from marriage." Best line right here. I had never even thought of this.
They are supposed to recognize legal marriages from other states. That is what the full faith and credit clause of the constitution requires, recognition of legal contracts from other states. DOMA violates the constitution by allowing states to violate this clause. And, you could argue that by recognize cousin marriages from other states, despite those marriages being illegal in Indiana, that Indiana is violating the 14th amendment rights of gays by not giving them equal protection under that same policy.
