If a man marries a rhinocerous is it really a marriage?

What if a judge declared that men could marry rhinoceroses?

What if the state legislature passed a law that men could marry rhinoceroses?

Would that mean it's really a marriage?

Can the laws of man completely overthrow the laws of nature and make a marriage whatever we wish it to be?

 

Any ideas on how rhinos can enter legal contracts? Since that's what marriage is?

 

If it is LEGALLY allowed and/or defined as such, the answer is Yes.

 

It would be hard to support as a civil contract of marriage without proof that the Rhino consents.

Does the Rhino consent to sharing all assets with the man? In the event of the man defaulting on a debt does the Rhino consent to pay the debt or settle any consequent lien?

Is the Rhino willing to act as a medical proxy if the man is incapacitated and ready to make medical decisions on the man's behalf? How will we know?

In the event of the Rhino requesting a divorce what happens to any children the couple have adopted?

Can the Rhino take a job and earn enough to look after the kids and also pay alimony to his/her estranged husband?

Can the Rhino dump the kids on the man and hop on the next flight to Rio never to be seen or heard from again?

All of the above examples clearly show that a man/rhino combination is substantially similarly situated to a fertile heterosexual coupling and IDENTICALLY SITUATED to an infertile heterosexual coupling in just about the exact same way that same sex couples are.

If either answer is no, then it is not a legal marriage.

 

If law is changed to allow Rhinos to enter contracts then it would be a legal marriage. Now divorce is a different story plus I doubt they would ever recognize it in Texas.

Does anyone realize that the "contract" of marriage is not a contract between the couple but a contract with the State? The contract is always active even if you get divorced (thus giving the State power over those contracted for things like child support) and lasts until your death.

Human laws cannot alter natural laws. The opinion of a judge or legislature cannot make water fall faster or change the direction of gravity. Even when rulers insisted the world was flat, the globe we sit on ignored their rulings.

Marriage is not a natural law. It is a legal or social institution created by people for the convenience of people. It therefore can be changed by people. So yes, in a strange future where enough folks felt strongly about it, they could change the laws to allow a man to marry a rhinoceros. Although I'm sure someone even then would dissent if the rhinoceros was male.

 

I'm pretty sure "marriage" is a man-made concept, not a product of nature. Nature has little concern for monogamy, religious ritual, or civil and financial consequences of marriage.

Here's a better question: Does legal definitions and applications have to do anything with what the people practice and believe in the privacy of their own home and religion? Of course not... even its current legal form, there are a wide variety of opinions on what constitutes a marriage and what social and religious ramifications it implies. Some people and religions don't even consider you "married" unless you do so with a proper ceremony, while others don't consider you divorced even if you "legally" are so.

The law is not a dictionary. It's a practical document, aimed at executing some political purpose. Unlike a dictionary, laws must serve a legitimate state interest, both narrowly and sufficiently. As such, you will often find that words when used in law often don't match their common uses.

 

In 31 states a 16 yr old cannot enter into a legal contract, but they can legally marry.

Some male of the species will fight to the death to preserve monogamy. Monogamy is important in species where the male and female join together to raise the offspring. Where the male plays no part, it is unimportant. Mountain gorillas are monogamous, bonobos are not. Male mountain gorillas will fiiercely defend their young, fighting to the death to protect them, while he will kill infants not fathered by him. Bonobo males dont know which offspring are theirs and take no part in raising the offspring and wouldnt make an effort to defend any infant.
