Internet shocked at Biden judicial nominee's failure to answer simple question on legal procedure

    Joe Biden has nominated yet another unqualified judge to a federal bench. One of Biden's problems here is his equity stances regarding judicial nominees and his cabinet. The retiring judge was black, which limits his options. His base gets very mad if he nominates a person of a different race, except when a minority replaces a white person. So he needed to find an equitable replacement.

    His nominee, Kato Crews, is a magistrate judge, which is a person nominated by other judges and is not elected or confirmed outside of the court that they serve. They're typically used for administrative purposes and minor offenses and cases. Crews is only the third magistrate judge to be nominated for a promotion to a federal bench in the history of Colorado, with the second one being nominated by Biden this past year. That is to say; it isn't very common.

    Senator John Kennedy is known to ask 101-level legal questions to nominees, and Democrats on the Senate Judicial Committee and White House staff provide the nominees with a list of questions he has asked in the past so they can be prepared.

    Yesterday, Kennedy asked Crews if he knew what a Brady motion in relation to Brady v Maryland was. Crews said he did not. This is extremely embarrassing as any qualified judge would instantly know the answer to this question without any preparation. Brady was a case in which the Supreme Court held that the prosecution must turn over all evidence, including favorable evidence, to a defendant that may influence their perception of guilt or punishment.

    It has come to national attention recently as the Q-Anon Shaman's attorney has said they requested additional video from the prosecution numerous times and were never given any footage shown on Tucker Carlson. They would have wanted that evidence when negotiating their plea bargain and 41-month sentence. It's also a common concept frequently brought up in legal movies and TV shows. So it's something that you would pick up via osmosis just by being in the legal world.

    Just more incompetentcy see from this administration. Like the luggage thief who dresses like a woman and is somehow in charge of nuclear waste.

    Before becoming a magistrate judge he primarily defended employers from employee and union lawsuits.
