Is Anyone Interested In Constitutional Defense And Enforcement?

If constitutional defense and enforcement was as simple as aligning with formal agreement upon use of the 9th amendment and then petition to state legislators to use Article V to see rights retained but unwritten, finally written, would you support that by agreeing to the second of these rights?

The second declaration assures the first right can manifest. The framers did not provide empty rights for us, that is certain.

Ninth Amendment

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

If a majority of State Citizens demand by petition that the state legislation forms a convention to propose the enumeration of the PURPOSE of free speech, it cannot be denied or disparaged

Article V

The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.​

The bolded portion shows Article V requires all amendments have constitutional intent. But state legislations, the congress and the court cannot define rights not enumerated. Only the people can and when they do so, no one in government can deny or disparage the rights retained that are defined. This make Lincolns 1859 statement in a speech, "the people are the rightful masters of the congress and the court", true, when 3/4 of the states are proposing and ratifying by conventions in their state.

There is a legal process here State Citizens can engage to use this. Events in our nation indicate that it is time for Americans to widely share this strategy with friends and family and begin to create this form of constitutional unity under law.

One thing is certain, the political system is broken and government is largely corrupt. We need a method of filtering out the bad ones and aligning the good ones with us under the constitution.

The complaint level about politics is horribly inconsistent with the support for fixing them.

It's hard to imagine adults thinking that politics as usual is going to fix anything, and just continuing doing what they've always done expecting different results is logical or reasonable.

It is things such as that which give rise to the notion that most the active posting here is a front and only exists to make the place look busy, whereupon the lurkers impression is that people involved with political discussion are boring repetitious people that could not think their way out of a box to save themselves, let alone their republic.

 

So there is not even excuse from people here for failing to discuss fixing what they complain about despite the fact that the fix uses what is written in the law of the land?

The trained monkeys are not working to get off the leash but instead take up turning the handle of the organ.
