Yeah you're right, the 9th Amendment gives us all the right to everything.

Or maybe you just don't understand it.

True. I'm talking about actual reality though.

There is no such thing as natural rights. Only man made rights which society agrees upon.

How can something that requires someone else to provide it for you be considered a right?

It gives us the right to anything absent compelling government interest. This is the strict scrutiny doctrine

No, you obviously don't understand it, at all. And that's fine, not everyone can know everything, but you need to be able to admit that you were wrong.

Madison and Hamilton were concerned that the Bill of Rights would be interpreted so as to increase the power of the Federal government, so they found this and the 10th Amendments to be important. It wasn't enough.

The greatest risk to our individual healthcare is posed by the federalization of our individual healthcare; which means that people like you pose the greatest risk to the healthcare of our nation. People like you are the National Calamity, because people like you never endeavor to spread greater self reliance and greater wealth, just greater dependency and greater poverty.

The reality is that this nation survived quite well for 234 years without a federalized healthcare system, and only in the past 8 years have we seen such a sudden increase in healthcare unaffordability. And it's the fault of people like you. We have 50 state governments for a reason, and we have 1 federal government for a reason, and it's not to provide a federalized healthcare system for 300 million people.

If you do not understand the doctrine of strict scrutiny I suggest you google it

Yeah, I'm familiar with it, I don't think you understand what it means though. It certainly does NOT give you the "right to anything absent compelling government interest", you've literally made that up. Strict scrutiny does not apply to us at all, it's a way of reviewing the constitutionality of any given law.

Uh....laws that could apply to any and all of us. For the government to deny you a right strict scrutiny must be applied. This is basic stuff

Ah okay, I see the source of the confusion here.

Okay, so this only matters if you assume that there is a right being denied. The entire point of this discussion is whether or not the 9th Amendment gives us the right to ANYTHING, so it makes no sense to employ the concept of strict scrutiny.

No the entire point of this thread is whether healthcare is a right or not. A case could easily come before SCOTUS that declares healthcare a right. Just like abortion and education.

That's why I said "discussion" not "thread."

They have never declared abortion to be "a right", and as far as I know they haven't done so with education either. They had to interpret other rights in such a way as to cover abortion.

You're right, the Supreme Court can say whatever it wants, that doesn't make any of it true.

I'm in favor of Federal involvement in the healthcare system, but I'd like an Amendment to be passed

Amendment unnecessary. We can just have SCOTUS do it

Why have a Constitution at all? Just let SCOTUS tell us what they want us to do.
