How can one possibly be prosecuted and/or punished for giving information about legal activities in another state? It doesn't make sense to me and just reeks of big brother government trying to control our lives. When Roe was overturned, republicans said women can just travel to another state. Now, doctors who tell a patient where abortion is legal can have their licenses revoked. It's a good thing the judge blocked the law, but it's only temporary. Hopefully sanity is restored and state's start realizing they subverting our God-given rights.
If he is giving the information in relation to his medical practice, then it is commercial speech which has a checkered history legally speaking. Not allowing commercials selling cigarettes, for instance, or regulating alcohol or gambling advertising are comparable instances.
Yeah well. On the other side the opponents say that a doctor may not assist in preforming an abortion. And referring to an other state is somehow "assisting". True, he is assisting that patient. But he is not assisting the abortion itself. That's far more bending how to interpret things.
