Judge orders resentencing for Rand Paul neighbor after ruling 30 days too lenient

    A federal appeals court judge on Monday ordered the resentencing of the neighbor who assaulted Sen. Rand Paul, R-Ky., in 2017 after ruling the original 30-day sentence was too lenient.

    "Federal defendants with a criminal history category of I who were convicted of assault received an average sentence of 26 months’ imprisonment and a median sentence of 21 months,” the 16-page ruling states, citing data. “We therefore VACATE Boucher’s sentence and REMAND for resentencing.”

    Rene must have soiled himself when he found out he wasn't going to get off the hook so easy.
    It's not nice to tackle a senator even if he is your neighbor. I have no sympathy for Boucher. He was a jerk when I knew him and apparently still is. I'll guess he gets 2 years.

    That's one less democrat who will be voting in 2020 if he gets a speedy trial. :clapping:

    Perhaps Rand will engage in yard work again, too bad Rand didn't exploit the politically motivated attack for all it was worth - A Dem. surely would have... Tragedy being an opportunity to be exploited to the fullest, advancing a partisanly fomented narrative & all, lol...

    Finally the left wing violence has a price. The Antifa bike lock guy got probation.

    This judge needs to oversee all violent Antifa assault cases.

    Yet you want prison sentences for Trump associates who didn’t violently attack and injure anyone.

    Paul also got over $500,000 damages in his civil suit. I can only guess what actually triggered ol' Rene. From what I remember, he liked to imbibe quite a bit. Something made him go off on Paul though and I don't think it was just lawn trimmings blown in his yard.

    30 Days seemed fair.

    Probation could've served the same purpose (since the guy is unlikely to re-offend).

    He already pleaded guilty. I think this is just going to be a one on one resentencing hearing with a higher court judge who knows the law better.

    Just about every thug in Chicago’s prisons were deemed likely not to re-offend until they offended again and again and again. Yet you guys still want to release them.

    Nope this is a Federal case. He's probably going to a medium/max pen. It won't be any country club.

    The guy is a Retired Doctor.

    Most likely has some money.

    He will go to one of those cushy Club Fed places.

    But, who knows?

    His Re-Sentencing will be interesting.

    Tackling a senator is in this case
    should include "hate crime" consideration.

    Also tackling a member of Congress should carry some weight.
    Not like an ordinary citizen.

    Yes he had some money. I knew him when he was going to school to be an Osteopath. He must have went back to med school at some point to get certified as an anesthesiologist. I ran into an old girlfriend at the airport who I had not seen for a few years. She told me she was on her way to Kentucky to get married to him there. That was about 30 years ago.

    So many years pass and I get a call from another friend that his wife (my old friend) was in town and would like to meet. We met for brunch. At that time she told me she had divorced him and showed me a picture of the house she was awarded. It was the same brick 2 story colonial that was shown on the news in 2017 when he was first arrested. I know she was getting alimony and maybe some child support.

    He had a lot of legal expenses both federal and civil. There is a $580,000 judgment against him for the civil suit. He is also now retired now so he's not making money any more. He might not even be living in Bowling Green. My guess is he's about broke and won't be able to pay for any high priced lawyers to plea down what the judge thinks is fair. If the average is 26 mo. I'm guessing 18-24 mo. + 3-5 year probation. I bet it will be the Federal pen in Minnesota if he shows remorse. If not, probably one of the Pens in Colorado. It won't be fun for him.

    Huh? He was already convicted.

    This Dem already got a great break for not being charged on the terrorist laws. He clearly was acting for political reasons and butt hurt his party and it's radical policies were rejected

    According to the Court it wasn't fair,....and the Court highlighted how it wasn't in the opinion....but i guess white, rich Dems get treated differently under the law in your opinion

    He is not going to be retried, he is being resentenced and that doesn't involve a jury.

    I don't read he's getting a new trial, just a new sentence... I imagine that will happen long before the 2020 election.

    However, it's just minutely possible that this news will allow Kentucky to finally go red in 2020...

    30 days did sound a little cheesy, but 2 years sounds a little harsh... I would think 10-12 months would split the difference and teach the lesson...

    The larger question is - Is this guy an ongoing threat to society?? The answer is likely No....

    Yeah, well as usual you failed to read everything. In my later post #9, I stated that he had already pleaded guilty and further that this would probably be a one on one resentencing hearing, no new trial, no jury present. At any rate, I doubt he will be voting in 2020.

    I actually knew the guy and his wife. He was a loose cannon several years ago. He may have changed over the years but I sort of doubt it. His wife is a very easy going person. If he couldn't get along with her, he has a problem. A couple years in the cooler might make him less of a jerk once he gets the crap beat out of him a couple times in the pen. I expect the judge to go with the average sentence, especially since she is who red flagged the light sentence the lower court gave him.

    Rand Paul may be a loose cannon politically, but no one should be the victim of such an assault.

    Arm chair lawyering is not easy. Not even so called lawyers get all the legalize correct every time. So, yes, my OP was a gaffe I guess.
    I realized he and already plead guilty and that he would only be resentenced, not re-tired, after the 15 minute time limit to edit had expired.
