The burden of proof is on the prosecutor.

If you think Trump is somehow being railroaded then either you are lying and you have not read the indictment or you are delusional.

Under 793(e) the classification status of the documents is irrelevant.

Because they haven't challenged any part of the process by bringing it up. If the docs were actually declassified, then they would be publicly available and there would be no need to go through the security process that's being discussed this week. But it doesn't really matter if they were declassified or not when it comes to the crimes he's being charged with.

There's also the fact that, rather than seeing a LEGAL route to retain the documents, such as handing them over as requested and then suing to have them returned, or challenging the subpoena in the first place, Trump tried HIDING the documents.

Sure . . . railroaded by facts and evidence. I'm glad you agree that the facts and evidence indicate that he's ****ed.

Ummm, if they aren't classified, it is relevant...lol.

If a document is unclassified, then it's considered that that information can't be used to harm The United States.

Everyone following the case knows that. You aren't following the case.

Absolutely true. There are millions of unclassified documents that aren't on the internet and can only be obtained via FOIA request.

If that were true you'd have no reason to ask this...If obstruction was the only reason he got charged, then why was he charged with all that other stuff?

Again, all you are doing is telling us that you have not read the indictment while not saying that you have not read the indictment.

In the indictment it lists the 31 documents that Trump is charged with under 793(e). Granted most of them are marked as Secret or Top Secret but document #11 has no markings.

Again 793(e) does not require that the documents be classified.

Do a LITTLE homework won't you?

793e says national defense information that can do harm to The United States. If it can do harm to The United States it shouldn't be unclassified. Wouldn't you agree? Of course you do. If it isn't classified, it can be obtained via a FOIA request. I don't believe our government is quite that inept, yet.

For someone who cries about others staying on topic you sure do like to derail them.

His attorneys have had the opportunity to offer this defense. They have not done so. And we have Trump on tape admitting that his whole "I had a standing order that all documents I took home were automatically declassified" thing was a lie. Plus, again, he tried to hide the documents instead of taking the legal route. Were back to the part you already admitted before: that the evidence so far means Trump is ****ed.

Don't ever tell anyone else ever again to stay on topic. If you do, I'll link this page to whatever post you say it in. Keep the hypocrite hat on though, you're great at it.

So did I. I even provided a link. You can lead a horse to water, but if he's been convinced that he's not thirsty, he won't drink a drop.

No, he isn't ****ed. If Smitty doesn't get a conviction by about December, he's going to have to go full stop until after the general election, at best. There's a DOJ rule that prohibits prosecutions that could affect elections.
