U.S. senator calls on Britain to demand 'immediate return' of Lockerbie bomber Al Megrahi because he's still alive after three months

Gordon Brown was told last night that he must seek the immediate return of the Lockerbie bomber to Britain.

A senior senator in the United States has written to the Prime Minister to protest that Abdelbaset Ali Mohmed Al Megrahi's early release on compassionate grounds on August 20 was granted on the assumption he had only three months to live.

Charles Schumer said that period had now elapsed and there was speculation that the severity of the Libyan's condition had been exaggerated.

Megrahi, who has prostate cancer, was serving a life sentence for the 1988 Pan-Am 103 bombing before being freed to fly home to Tripoli.

There is growing pressure for all of Megrahi's medical papers to be published, as well as monthly updates on his health which he is required to give to the authorities in Scotland.

Mr Schumer, from New York, said: 'The bottom line is Megrahi should have never been released in the first place but it would be even more outrageous if he were to be able to live a long and free life after his release.'

He said he had written to Mr Brown 'demanding' that the British Government seek Megrahi's immediate transfer back to a Scottish jail.

'The victims of Pan Am Flight 103 didn't get a second chance at life and neither should Megrahi,' he said. 'Justice in this case was life in prison, no exceptions.'

Rosemary Wolfe, president of Justice for Pan-Am 103, which represents the families of the 270 people who died, said last night: 'It does not surprise me that he is alive and well. It was a major mistake for the Scots to let him go. It was just horrible.'

Another relative, Susan Cohen, whose daughter Theodora was killed on the flight, said: 'Scotland was shameful in this and so was the whole British Government. It is absolutely sickening. He is in the hands of Libya and when he is dead, we want to see the body.

'If he had been in Scotland, we would have at least believed it when told he was dead.'

Ministers have conceded that business and security interests would have been threatened if Megrahi had been allowed to die in jail.

Critics have alleged the Government cynically delivered a series of concessions to the Gaddafi government in exchange for lucrative oil deals with Libya.

But the Foreign Secretary David Miliband has denied any 'double dealing' and insisted the Government did not lean on the Scottish Executive to release Megrahi.

Megrahi has not been seen in public since September, when he was photographed in a wheelchair.

His brother, Mohammed, said earlier this month that Megrahi was in hospital. But it is not clear if he is still there or back at his family home in the Libyan capital.

Under the terms of the release Megrahi is supposed to update officials in Scotland every month via a video link on his medical status.

Bill Aitken, the Scottish Tory justice spokesman, said all relevant documents should be made public.

'Megrahi lost all rights to patient confidentiality when he became Britain's worst mass murderer,' he added.

August 23, 2011 - US and British politicians want Libyan rebels to extradite Abdel Baset al-Megrahi, the Lockerbie bomber released by Scotland in 2009 after doctors gave him three months to live.

Libyan leader Muammar Qaddafi's seemingly imminent fall has given rise to new calls for the capture – and re-imprisonment – of freed Lockerbie bomber Abdel Baset al-Megrahi. Mr. al-Megrahi, who has been diagnosed with prostate cancer, was freed by the Scottish government on "compassionate grounds" after doctors claimed he probably had only three months to live. But that was two years ago – a fact that has sparked renewed condemnation among US and British politicians.

Prime Minister David Cameron says it was "wrong" for Megrahi to be released early from his jail term in a Scottish prison, his Downing Street spokeswoman said. Those comments are likely to galvanize calls in the US for him to be extradited from his Libyan sanctuary. Republican presidential hopeful Mitt Romney said the rebels should turn over Megrahi once they complete the takeover of Libya. Member of the British Parliament Robert Halfon, of Cameron's governing Conservative Party, said he should be "brought back" to the UK, "spend the rest of his life in a Libyan jail," or "be extradited to the US."

At the time of his release in August 2009, many critics of the plan suggested it was being done to secure multimillion dollar oil deals with Libya. But the British and Scottish governments at the time have insisted the decision had been taken by the Scottish Justice Minister Kenny MacAskill. British officials have already said there appears to be no official mechanism under which he could be brought back to the UK. As the Scottish justice system is independent from that of the rest of the UK, Mr. Cameron's government has no jurisdiction over Megrahi.

What's more, the Scottish government has shown no sign of changing its steadfast position on the matter – one it has maintained since Megrahi's release amid mounting criticism. A government spokesman said Tuesday he was sent back to Libya "according to the due process of Scots law because he is dying of terminal prostate cancer."

Lockerbie bomber Abdelbaset Ali al-Megrahi is in a coma at his Tripoli home in Libya, it is being reported. CNN said Megrahi appeared to be "at death's door" in the care of family. He is technically on licence but his whereabouts had been unknown. Megrahi was freed from a Scottish prison in 2009 on health grounds. There have been calls for him to be returned to jail in the UK or tried in the US. But Libyan rebel leaders have said they do not intend to allow his extradition.

'Surviving on oxygen'

Abdelbaset al-Megrahi had been jailed in 2001 for the bombing of a US plane over Lockerbie, with the loss of 270 lives, before he was diagnosed with terminal prostate cancer and freed. Scottish officials had tried to contact him following the rebel advance into Tripoli. Megrahi technically remains a Scottish prisoner released on licence and is obliged to remain in regular contact with East Renfrewshire Council. On Friday, the Scottish government said he had not been due to contact them for some time yet but social workers from East Renfrewshire Council had been endeavouring to contact him.

'Unhelpful speculation'

After reports Megrahi had been found, the government and council issued a statement saying they had been in contact with his family over the weekend and his licence had not been breached. "Speculation about al-Megrahi in recent days has been unhelpful, unnecessary and indeed ill-informed," they said. "As has always been said, al-Megrahi is dying of a terminal disease, and matters regarding his medical condition should really be left there," they said. "Any change in al-Megrahi's circumstances would be a matter for discussion with the National Transitional Council as the legitimate governing authority in Libya." A neighbour in Tripoli had earlier said he was whisked away by security guards last week as Gaddafi's forces crumbled.

CNN reported on Sunday that Megrahi was "comatose" and "near death... surviving on oxygen and an intravenous drip" and not eating. "We just give him oxygen, nobody gives us any advice," Megrahi's son, Khaled, told the US broadcaster. "There is no doctor. There is nobody to ask. We don't have any phone line to call anybody." CNN reporter Nic Robertson said he last saw Megrahi two years ago and described his appearance as "much iller, much sicker, his face is sunken... just a shell of the man he was". Megrahi is the only person to have been convicted in connection with the bombing of Pan Am flight 103 over Scotland in 1988.

You can't exactly set your watch when doctors tell you that you have x months to live. That's basically just a predictions based on the average time someone in your shoes has. Some die earlier, some die later and some die of old age.

Lockerbie bomber case may reopen with new Libyan government
August 30, 2011 - Lockerbie bomber: the US is calling for the Libyan transitional government to look at the Lockerbie bomber case while Abdel Baset al-Megrahi reportedly fades in and out of consciousness.

The Obama administration has asked Libya's opposition to review the case of the ailing former Libyan intelligence agent convicted of the Lockerbie bombing who has been living in Tripoli since his release from a Scottish prison two years ago, the State Department said Monday. The department said it wants the opposition to look into the handling and terms of Abdel Baset al-Megrahi's return to Libya. Al-Megrahi was released on compassionate grounds in 2009 and returned home to a hero's welcome from supporters of Moammar Gadhafi. He is now near death and slipping in and out of consciousness, according to his brother. His release by Scottish authorities was loudly protested by the U.S., as were the circumstances of his return to Libya.

State Department spokeswoman Victoria Nuland said U.S. officials have spoken to senior members of Libya's Transitional National Council about the case. She said the TNC had agreed to look into it once it consolidates control over the country and establishes a fully functioning government. "We asked the TNC to, as soon as it can, take a hard look at what it thinks ought to happen with Mr. Megrahi, and it is committed to do that," she told reporters. "This is a new day in Libya," Nuland said. "This is a guy with blood on his hands, the lives of innocents. Libya itself under Gadhafi made a hero of this guy. Presumably, a new, free, democratic Libya would have a different attitude towards a convicted terrorist. So it is in that spirit that the TNC will look at this case."

Also Monday, White House spokesman Jay Carney said the U.S. has no indication that Gadhafi has left Libya. The Algerian foreign ministry said Gadhafi's wife and other relatives fled to Algeria. Libyan rebels have effectively ended Gadhafi's rule, but have yet to find the longtime leader. Carney said the administration is continuing to work with rebels and NATO partners as the situation in Libya unfolds and would pass on information about Gadhafi's whereabouts if it had them. Calls for al-Megrahi to be returned to prison have increased in the U.S. and Europe since rebel forces seized control of Tripoli last week, but it is not clear whether that could happen. The Scottish government says it has no plans to ask for him to be returned, and al-Megrahi's brother says he is so close to death that there would be little point.
