Yes, this is Alvin Brag. the same Alvin Brag that ignores real crime and runs (OK, walks 'cause he's too fat to run) after Trump.

The parking attendant wrestles the gun away from the man who just shot him, shoots the bad guy and goes to jail. Now, they haven't yet posted a picture of the criminal but considering Alvin Brag's MO, there's virtually no chance he isn't black. Funny how that works.

This is not a 'bad' neighborhood. This is right next to Madison Square Garden, and I'm sure I've parked there in the past. This is another disgrace of the liberal mentality that is ruining this country.

 

Just wow, and Bragg is charging the victim with criminal possession of a weapon, because he took the weapon away from the would be killer.
This DA needs to be charged.

Not sure why when the police are involved with such incidents, there is no charge.

 

New York State does not have a stand-your-ground or castle doctrine for self-defense. The key here is "was the garage worker in reasonable fear for his life." He did wrestle the gun away and fought the attacker, that is clearly self-defense. But the moment he had the gun, the idea that he was in fear of his life may no longer be appropriate. If he fired while the robber was fleeing, then I can see the attempted murder charge.

However, according to your own article, it is not clear if the DA would follow through on the attempted murder charge of Diarrea. The suspect who attempted to rob is facing the exact same charge as Diarrea as well. And if the stories don't match, then the police usually do this and let the DA sort it out in some districts.

If Diarrea attempted to keep the gun, then the gun charge would stick. Otherwise, I suspect the charges may be dropped. And a good defense attorney can get this done.

 

If you read the article, both are charged, the person who attempted to rob the garage and the garage attendant. both with the exact same crime. It happens. It is rare, but it happens when there is no castle doctrine when it comes to a place of business that he does not own. But give it time, Diarrea will have most, if not all charges dropped with a good defense attorney at hand.

There is something wrong with this crackpot. He has turned justice on its head simply because the victim chose not to die that day.
They should fine the county $100K per day the victim was in Rikers.

It happens sometimes, whether in NYC or in Houston Texas if the stories don't match or there are facts that the news article is not reporting. Again, let the process work itself out before getting all uppity about it.

Alvin Bragg and his prosecutors have a history of going light on criminals and being tough on crime victims who defend themselves. Yet again, they have charged the victim of a crime...

A parking garage security worker caught a man checking out vehicles with a bag. He confronted the man and asked to see what he had in his bag. Instead, the man pulled a gun on the security attendant. There was a struggle over the firearm and the attendant was shot in the stomach and then again in the head (grazed). When he wrestled the gun away he shot his attacker.

He is now being charged with attempted murder, assault, and criminal possession of a firearm (for having the gun he wrestled away from his attacker).

DA Bragg is infamously known for charging a shop owner after a robber tried to killed him. He held him in prison until public outcry grew too great and he was forced to release him and drop the charges. We have to wait and see what he will do with this case.

Just another reminder of how crazy this DA is.

 

Security guards are only allowed to kill unarmed Trump protestors.

 

Why bring politics and Bragg into it, this has nothing to do with federal jurisdiction.

 

Because Bragg is on a political mission.

Bragg is a county DA, not a Federal prosecutor.
