Is a right something the Federal Government can not prevent you from exercising? Or is it something you can demand from Government, i.e. taxpayers?

Public education is a right and the government must provide it.

Education is not a fundamental right in the constitution.

Rights, as in the founders and framers inalienable rights, are not something the government has and therefore cannot bestow. Nor or they something you are allowed to pursue. They are what you were born with a have. What you do with them is up to you.

The ninth amendment most definitely does not establish education as a fundamental right. And you will not find a supreme court majority ruling that education is a fundamental right. Try again

Education is not a Federal issue.

'Education in the United States IS a state responsibility. Providing a public education for kids is NOT a power granted by the states to the federal government in our Constitution, therefore it is reserved for the states.'

The 9th Amendment would not be applicable.

So you have nothing. I love being right. And fape does not magically make education a fundamental right.

Fape is a fairness law it just stipulates that you must treat children the same. If you provide education for children then handicapped children must be accommodated. That is still not a fundamental right. Once again post one article proving that education is a fundamental right granted to us by the constitution.

    Articles are opinions.

Every single child in America must be provided a free and appropriate education. That is a fact.

    It is their right

Even elementary education is not 'free', nothing is 'free'. The child may not be charged as such, but the taxpayers are paying for that education, regardless of who receives it.

You seem to think that taxpayers should continue to pay for people who are here illegally. Why?

Then post one supreme court majority judgement that sides with your argument that education is a fundamental right granted by the constitution.

That does not make it a fundamental right according to the constitution and supreme court of the United States.

Depends. Natural rights, protected by our Constitution is a right that government is not allowed to oppress. Human rights necessarily require oppression of natural rights to implement so...

Free education is not a natural right but a concept that an educated public can make informed decisions. One of the founders concern was that an uneducated public would not vote for ethical and moral leaders. Obviously a 'free' education is has not held up to their concern.
