This is a interesting one. Boyfriend and girlfriend at the age of 16 decide to text explicit images to each other. The images got into the hands of authorities and both are charged with being in possession of child pornography although the images were consensually sent to each other. Under North Carolina's laws, both will be charged as adults. The boy is charged with a felony of sexual exploitation of a minor although his 16 year old girlfriend sent him the images. The boy could face two years jail for each offence and be listed as a child sex offender. Hopefully for them they end up on the docket of a judge who makes this go away without them being sex offenders for the rest of their lives.
Now that's getting stupid. The police and prosecutors have a duty to evaluate the situation before issuing charges. Good judgment wasn't used in this case.
