NV man claims 'stand your ground'--shoots sleeping couple in his vacant property!

    Come on! These people were certain 'lowlifes' but they WERE ASLEEP for christsake. Now you don't even have to be awake to be considered a threat and SHOT dead?? Oh well, at least it isn't Florida this time!

    A Nevada man said this week that he was innocent under Nevada’s “stand your ground” law after he fatally shot an unarmed man and wounded a woman who were sleeping inside one of his vacant properties.

    According to Sparks police, 73-year-old Wayne Burgarello was told that someone was trespassing at one of his vacant properties on Feb. 13, and armed himself with two handguns, KTVN reported.

    Burgarello found 34-year-old Cody Devine and 29-year-old Janai Wilson sleeping inside the home, and shot them. Devine was killed, while Wilson was seriously wounded.

    If the shooter's life wasn't threatened, then the shooter is in the wrong.

    Stand your ground laws do not defend those kinds of situations.

    May his soul rest in peace. May whatever god that he believes in look after his soul. And let's hope that Janai Wilson is also able to make a full recovery. Let's let justice be done here.

    Totally unnecessary escalation and use of force. The man deserves to go to jail for murder.

    The decision to escalate and use force has to be commensurate with the threat he faced. Trespassing in a vacant building does not warrant an armed confrontation, let alone the use of deadly force.

    I don't care what the shooter is using for his defense.

    Stand your ground laws do not defend those kind of situations.

    the shooter announced himself when he entered his own property

    the deceased was not sleeping but stood up before the shooting, thus not asleep. We then have a he said/she said with the words of the shooter vs the words of the doped up girl

    Wilson said as Burgarello approached, Devine started to get up from the floor and said they were just sleeping. That's when the shooting began, she told police.

    Burgarello told police Devine had moved his arm in a threatening manner. "The arm came up like a gun, and I reacted," Burgarello said, according to a police affidavit.

    Devine was shot five times, including once in the head, an autopsy determined.

    Pastor Rev. Howard Dotson, who organized candlelight vigils following the shootings, has criticized police for acting slowly in charging Burgarello.

    “You can’t hide behind ‘stand your ground,’” Dotson explained.

    “These stand your ground laws — people are getting killed for Skittles,” the pastor pointed out. “People are getting killed for throwing a popcorn box or having loud music, and now Cody was killed for being on a date.”

    One might think the last person to lie and use hyperbole would be a pastor.

    Who cares what he is claiming as his defense? The law will find him guilty of murder.

    And us "gun nuts" will rejoice in the verdict

    Don't worry, the NRA will come up with some sort of justification for this. Wayne is already seated in front of his PC working on a speech.

    I meant Wayne LaPierre; but I'll applaud if the NRA condemns Wayne Burgarello for his actions.

    Moral of the story.................

    1) Don't break into and squat in other peoples houses. They don't own it, they don't have any right to be there.

    2) Never try to bluff someone that you have a gun as the person they are trying to bluff may just have a real one, then bad stuff happens.
