This was a severe smackdown by the PA Supreme Court. They pretty called the Trump team liars and cheaters, because the Trump team waited until after they lost the election to challenge election law, even though they had ample time to do so ahead of the election.

They're right, obviously. It's very obvious open cheating to try to challenge election law only after you lose. <COMMENTS EDITED>

The want of due diligence demonstrated in this matter is unmistakable. Petitioners filed this facial challenge to the mail-in voting statutory provisions more than one year after the enactment of Act 77. At the time this action was filed on November 21, 2020, millions of Pennsylvania voters had already expressed their will in both the June 2020 Primary Election and the November 2020 General Election and the final ballots in the 2020 General Election were being tallied, with the results becoming seemingly apparent. Nevertheless, Petitioners waited to commence this litigation until days before the county boards of election were required to certify the election results to the Secretary of the Commonwealth. Thus, it is beyond cavil that Petitioners failed to act with due diligence in presenting the instant claim. Equally clear is the substantial prejudice arising from Petitioners’ failure to institute promptly a facial challenge to the mail-in voting statutory scheme, as such inaction would result in the disenfranchisement of millions of Pennsylvania voters.

Accordingly, we grant the application for extraordinary jurisdiction, vacate the Commonwealth Court’s order preliminarily enjoining the Commonwealth from taking any further action regarding the certification of the results of the 2020 General Election, and dismiss with prejudice Petitioners’ petition for review. All other outstanding motions are dismissed as moot.

Well that issue should have been addressed sooner if Republicans had an issue with it, not after the fact. Those people voted in good faith since there was no opposition, so their votes should be counted.

No, that can only happen if a third party candidate wins a few states and prevents anyone from getting a majority of appointed electors. The 12th amendment says whoever gets a majority of the _appointed_ electors wins. It does not say "a majority of all _possible_ electors". If a state doesn't appoint electors, the threshold needed to win goes down by one-half of that state's elector count. If PA is disqualified, the number needed to win goes from 270 to 260.

Biden would have to lose every single swing state for Trump to get more EV. All six of them. PA, MI, WI, AZ, NV, GA. If Biden keeps just one, he wins. And there's zero legal basis for overturning the election in any of them.

 

I believe that was a different case in which the CJ Roberts upheld the lower courts ruling that PA could count ballots up to 3 days after election day as long as they were postmarked.

 

Sorry no they punted, 4-4 tie. And in this case it's either the same or very much related because the three day period was orchestrated by the Pen. State supreme court, which has constitutionally no jurisdiction to do that.

How are they the same considering the PA supreme court didn't orchestrate Act 77? They said the Plaintiffs waited too long to file their lawsuit. They did not rule on whether or not it was constitutional. Perhaps this will be a lesson for Republicans to file their lawsuits on time.
