The YMCA violated state law by failing to ensure that Lhermine only worked under the direct supervision of a qualified teacher and that he was never left alone with children, the lawsuit said. On that day, Lhermine, who had worked as a YMCA aide for several years, was left alone with the girl and other young children while the supervising teacher was performing housekeeping duties, said the suit, which names the YMCA of Silicon Valley and Lhermine as defendants and seeks unspecified damages. Based on our investigation, Nicholas Lhermine was given routine and unfettered access to children alone, allowing him to molest children at a daycare center, said the girls familys attorney, Robert Allard. We intend to hold the YMCA fully accountable for failing to follow the law and protect children from a pedophile. An investigation by Morgan Hill police determined that Lhermine had sexually molested the girl and at least three other victims, authorities said. Santa Clara County prosecutors have charged Lhermine with numerous counts of child molestation. His preliminary hearing in the criminal case is set to begin in August. The civil complaint said several YMCA staffers had complained about staffing levels in the region and that they were fired about six weeks before the girl was abused. Several former employees have filed a wrongful termination and whistle-blower lawsuit.

Is this endemic to YMCA's? I belonged to one for about 4 years before moving on to a private gym. They always had two people on staff and the facility was across the hall from the front desk and the walls were glass. California has some of the strictest background checks in the nation. Obviously if this is a first time occurrence, I don't know what they could have done to prevent it. There needs to be a special hellish prison for pedophiles.
