The Administrative State, AKA "The Swamp" have been known to circumvent the applications of certain reg's because of partisan disagreements they have no business having.
When laws are passed they go the the swamp for interpretation and implementation.
The best course for Trump to follow is to decentralize DC into other areas of the country to prevent the "bubble syndrome" where DC federal Employees are estranged from the rest of the country. (Not mention spreading the wealth around.)
